Suits s09e08 Episode Script

Prisoner's Dilemma

1 - Previously on "Suits" - My name is Andrew Malik.
While you were kissing Cameron Dennis's ass, I was putting the real criminals away.
You may not have remembered me then, but you're sure as hell gonna remember me now.
I just got a visit from Sean Cahill.
- There's a way he can get you out.
- What's the catch? He needs you to inform on your cellmate.
I've been after Sutter for three years now.
This guy is one slippery son of a bitch.
You pulled every string you have to make this happen.
- You're gonna pull out now? - I am, 'cause I'm not gonna put myself in position to collude with you.
You filed a countersuit against my explicit instructions? I didn't ask you because you wouldn't have listened.
You set me up.
I'm gonna make sure the world knows.
You can tell the world anything you want, William, but you got no proof.
Either way, I suggest you sign this deal.
Damn it, you said you were gonna defend him to the best of your ability.
And I meant it, but I also knew, if push came to shove, I'd do what I had to to get Mike out.
So let's just admit that we're in this together and get this thing done.
You son of a bitch.
You got nothing on me because there's nothing to have.
The only question is, which of the many times that you've crossed the line am I planning on exposing to the world? Sean, what are you doing here? I thought you said you never wanted to see me again.
Believe me, Harvey, I wouldn't be here if Andrew Malik hadn't just had me arrested.
- What? - He's claiming we conspired to swap Mike Ross for William Sutter.
I'm here to get our stories straight.
You want our stories straight? I'm representing you as of right now.
Representing me? What are you talking about? You wearing a wire, Sean? You think I'm here to entrap you? Don't act like that's not possible.
You had me wear a wire to nail Charles Forstman, and now you're coming to me out of the blue, accusing me of colluding with you.
You know what, Harvey? You want to pat me down? Feel free if that's what you think of me.
What I think, Sean, is you need to take me up on my offer.
And how is that gonna look? You repping me when we've been accused of colluding? I don't give a shit what it looks like.
You hire me, we can talk about anything and it's not admissible.
All right, Harvey.
You're my lawyer.
Now let's talk about the story.
[TENSE MUSIC.]
Partner's log, stardate 2-0-1-9: The search for a baby name continues.
We have arrived at the letter L, where Sheila has sent me an email with her top three choices.
Levi Litt.
Great idea, Sheila.
Was "Jewwy Jewstein" taken? Linus Litt, otherwise known as "Linus Vaginus, the kid who died a virgin.
" - [SOFT KNOCK ON GLASS.]
- Esther.
What are you doing here? I know it's late, Louis, but I was hoping we could talk.
Of course.
Is this about the merger you wanted me to take a look at? - It is.
- Oh, well, guess what? I did.
And the deal is as solid as a rock.
So there's no reason for my board to turn it down? - No.
Not a one.
- [SIGHS.]
Shit.
Esther, what's going on? Louis, I'm gonna tell you something.
You have to promise me you're not gonna tell anyone and you're not gonna lose your head over it.
Esther, I don't understand.
15 years ago, Paul Richmond assaulted me.
What? But you always said he was your mentor.
He stopped being my mentor that night, Louis.
We were at a conference in Miami.
He asked me to his room.
The next thing I knew, his hands were all over me.
And when I pushed him away and told him to stop, he got angry, said I'd been leading him on.
He started forcing himself on me.
[TENSE MUSIC.]
Then what happened? I ran out there as fast as I could, went to my room, and threw up.
I can't have him in my company, Louis.
No, you can't.
Which is why you're going to go to the board right now and tell them what that motherfucker did.
No.
I am not doing that.
Why not? Because it happened 15 years ago.
And in case you haven't noticed, women who come forward get put through a meat grinder.
I know that, Esther, but Louis, I just told you what happened and the first words out of your mouth were, "But he was your mentor.
" You're my brother, and you said that.
What do you think everyone else will say? Well, I just can't let him get away with it! Louis, I know you want to rip his head off, but what I need from you is to make this deal go away.
[DOOR SLAMS SHUT.]
Before you say anything, I'm sorry that I took so long.
What happened? Did you pick the grapes yourself? The first place didn't have the bottle I wanted.
Ooh, '85 Côtes Du Rhône.
This is an outstanding bottle of wine.
There's also no way it's the reason you took so long.
- Donna, what are you getting at? - You care about whiskey, Harvey.
You don't give a shit about wine, which means that something stopped you.
And if you're hiding it from me, it must be serious.
All right.
I went out, and when I got back, Cahill was waiting.
Malik's coming after him for conspiring with me two years ago.
Oh, my God.
This is about Mike.
- It is, but Donna - Don't "but Donna" me.
Harvey, Andy Malik doesn't care about Sean Cahill.
If he's doing this, he's coming after you.
You think I don't know that? I know you know it, but you didn't want to tell me about it, and I want to know why.
Because I didn't want you to worry.
[SOMBER MUSIC.]
You mean because you're worried.
If Sean didn't just agree to let me represent him, I would be.
But he did.
So we're good.
"Good"? You don't even know what Malik has.
Donna, I know what we're up against, but I can't have you doubting me on this.
I'm not doubting you, Harvey.
It's just this whole thing hinges on you and Sean sticking together.
Do you really think we can trust him? That's what I'm telling you.
We don't have any other choice.
Suits 9x08 Prisoner's Dilemma See the money, wanna stay for your meal Get another piece of pie for your wife Everybody wanna know how it feel Everybody wanna see what it's like I'll even eat a bean pie, I don't mind Me and Missy is so busy, busy making money All right All step back, I'm 'bout to dance The greenback boogie Your Honor, this is outrageous.
Sean Cahill can't be represented by Harvey Specter.
They're using attorney-client privilege to get away with the conspiracy they engaged in in the first place.
Not engaged in, are accused of engaging in.
And how is it any different than a joint defense agreement? I'll tell you how it's different: you're setting this thing up for a mistrial.
Because when I win, that's exactly what he'll ask for.
Your Honor, I will resign as Mr.
Cahill's attorney right now if he hands this case over to someone else, but he won't, because no one else will touch it.
I'm not walking away from a case that I've been building for eight months.
And if you're so sure we did this, why aren't you coming after me? Because I focus on the bigger fish.
That's a load of crap.
You're not charging me because you know it'll look like a vendetta.
All right.
That's enough.
Are you willing to waive your right to a mistrial, Mr.
Cahill? I am.
Then I'm afraid he has a right to his counsel of choice, Mr.
Malik.
And I want discovery documents in his offices in an hour.
[GAVEL POUNDS.]
Hey, you think he's gonna get you out of this, but he doesn't care about you.
He only cares about himself.
If we're supposed to be sticking together in this, what the hell are you doing volunteering to drop me? Sean, I did it to make a point.
He was never gonna take me up on it.
And if he did, I'd be in this alone.
So next time you feel like freelancing, why don't you run it by me first? Okay.
I will.
Now let's get back to the office, because if I know Malik, there's gonna be some kind of curveball in that discovery.
Whatever it is you're doing, I got something more important.
In that case, I'm all yours.
What do you need? A legitimate reason to stop a merger from happening.
This is Esther's company.
It is, and she used to work for the man that runs the other company, and let's just say they are like oil and water.
If that's true, why does he even want to merge with her? Because my sister's a brilliant businesswoman and the easiest way for a scumbag like that to make money is to leech off of her success.
Now, do you want to help me solve this or not? - Of course I do.
- Good, because a lawsuit'll gum up the works, but I don't see any grounds.
- What about other suitors? - Nope.
Too late for that.
Her board just got proposed to, and no one's walking in with a bigger diamond.
Louis, when it comes to diamonds, bigger isn't always better.
There is cut, there is color And there's clarity, which means that 30% premium is compensating for something.
Therefore, if we want to tank this deal, we just have to figure out what it is.
Faye, if you're here to thank me for letting you off the hook with the Bar, I've got my hands full at the moment.
According to Andrew Malik, you should have plenty of time.
I don't believe this.
He called you? Yes, he did.
He wants you off this case, - and I agree with him.
- Okay.
I know you're not a real attorney, so I'm gonna spell it out for you.
He's using you because he knows I'm gonna beat him.
I don't care what he's doing.
I don't want you handling this.
I just went to court to be able to represent Sean.
I'm not going to turn around and drop him.
And I'm not saying we should.
I'll represent him.
You? I could have two hands tied behind my back and cinder blocks at my ankles, and I'd be better than you.
No, you wouldn't because you colluded with the man.
Your interests are at odds with each other.
In other words, you think I did this.
I don't think you did it.
I read you did it.
What the hell are you talking about? Malik has an affidavit from Kevin Miller swearing that you conspired with Sean Cahill to get him and Mike Ross out of prison.
You once told me you got Mr.
Miller out of a jam.
Well, now I know what that jam was and what it took to get him out of it.
Well, you know what? I'm not on trial here; Sean is.
And if you want to file a motion denying my client his attorney of choice, then go right ahead.
But until then, I've got actual work to do.
Louis! What a pleasure to finally meet Esther's brother after all these years.
I understand you have some questions regarding the merger.
I'm not here to ask questions, Paul.
I'm here to tell you this merger is not happening.
Well, that's certainly news to me.
Just like it was news to us that your supplier is on the brink of bankruptcy.
You're looking for a lifeline, and that's what this is really about.
What this is about is two companies that have synergy utilizing their respective resources.
Well, you're gonna have to go after someone else's resources because as of right now, ours are off-limits.
And I informed your board of the supplier situation, which makes me think you're not here on behalf of your client.
You're here on behalf of your sister.
You're damn right I am.
Well, then, this is inappropriate.
- Excuse me? - I assured the board I won't let her go.
Anything beyond that is between she and them.
Well, according to company bylaws, we have one day to reject this offer, and I'm triggering that right now.
You can't do that without board approval.
Well, then I'll find some other loophole because you're not getting anywhere near my sister's company.
Well, then as far as I'm concerned, it's not your sister's company anymore.
It's mine.
You piece of shit! I know what you did! And if you don't back off, so help me, I will come right after you! I have no idea what you're referring to.
15 years ago, asshole! Miami.
You attacked her.
You know you did.
That's why you went to her board and not her because you knew she would never agree.
And if that were true, why did she stay with my company for five more years and is only now fabricating this whole thing? I'll tell you why: because she's looking to save her job.
So unless you want to defend her from slander, you'll drop this.
Now get out of my office before I call security! [DRAMATIC MUSIC.]
We've got a problem.
You're damn right we do.
Was Mike Ross really dumb enough to straight up tell his cellmate what we did? He wasn't dumb, Sean.
We needed Kevin to trust us.
And that's another thing you should've run by me, 'cause now I have to go tell that ex-con if he doesn't recant, I'm gonna slap him with a parole violation and he's going back to prison.
And you do that, Malik will get you for witness tampering.
I'm not gonna sit on my hands and just do nothing.
You're right.
You're not.
Malik went over my head.
I think it's time we went over his.
Why don't you bring some of that SEC pressure to bear on him? I get it.
This is a vendetta, and when it goes south, it's gonna look as bad for Malik's superiors as it does for him.
In the meantime, I'll keep wading through this shit, - because something doesn't smell right.
- What do you mean? I mean the Sutter case was in the public record and so was Mike's release.
So why is Malik bringing it up years later? I don't know, but the person that can shed light on that very question is Kevin Miller.
Harvey.
I can't say I'm surprised to see you.
I may not be surprising you, Kevin, but you sure as hell surprised me.
Look, if you wanna call me an asshole, - you might as well get to it.
- I'm not here to yell at you.
I'm here to find out what the hell are you doing playing ball with Andy Malik.
Harvey, he said if he convicted Cahill and we didn't cooperate, he'd void the deal we made, Jill would go to prison, and I'd go with her.
And let me guess: he gave you immunity in exchange for talking.
And he made it contingent on me not warning you about it.
I'm sorry, Harvey, but I was backed into a corner.
You should have come to me anyway.
You owed me that much.
I know I owe you.
That's why I didn't give Malik everything.
He has my affidavit, but he doesn't have proof.
The recording I made of Sutter.
I didn't tell him it exists and I'm not going to.
But if you're here to get me to change my story, that's as far as my owing you goes.
Then answer one question.
We did this years ago.
Why didn't Sutter go to Malik until now? That's the thing.
I don't know who went to Malik, but it wasn't him.
How can you know that? Because Sutter died eight months ago.
[SOFT MUSIC.]
Here's what I don't get: Malik couldn't know any of this without Sutter, which means Sutter must have reached out to him before he died.
But that was close to a year ago, and there's no reason Malik would sit on this for that long.
Then he must have found out from someone else, because there's no record of any conversation between Malik and Sutter ever.
That doesn't mean it didn't happen.
It means Malik's hiding it.
Harvey, why would he expose himself like that? The case could get tossed on a technicality.
He's played fast and loose before.
Maybe he's doing it again.
He might be, but not about this.
The warrant that Malik used to go after Kevin Miller had to show probable cause.
It turns out it was a deathbed confession by Sutter to an informant whose name was redacted.
Under what grounds? To protect him against retribution in prison, which is what I wanted to show you, because the name of the prison is gonna ring a bell.
Holy shit.
Pat me on the back later, Harvey.
It's what needed to be done.
Well, what needs to be done right now is for me to go see an old friend.
What the hell did you do? I came to you to find me a way out of this, and the next thing I know, my own board triggered my buyout clause.
Shit.
You fucking told him, didn't you? Esther, you weren't there.
- I tried not to say anything, but - God damn it.
I told you I didn't want anyone to know about this.
Now I'm not only losing my company, but you gave the son of a bitch responsible for it the satisfaction of knowing what it's done to me.
Esther, I know I screwed up.
But I was in there and he had us and he knew it, and I just snapped.
But we can still get this son of a bitch if you just come forward.
- What did you just say? - I should've insisted this was the way to handle this in the first place.
You need to let the world know what he did.
- I told you I am not doing that.
- God damn it.
How could you give him the satisfaction of getting away with this? Because he will get away with it and I have children.
And what happens when they ask why I went to his hotel room? Why did you go to his hotel room? Because I'd known him for years and we've traveled together 50 times and I never thought he could do that.
Well, then say that.
How many times do I have to tell you? I don't want them to twist what I say and have it go in the "Journal", and have to put my children through that - Esther, don't - That's enough.
I came to you to protect me like I protected you a thousand times when we were kids.
And I was dumb enough to think that, with a baby on the way, you might finally understand when something matters to me.
But you don't.
So leave this alone and leave me alone.
[DRAMATIC MUSIC.]
Harvey Specter.
Long time no see.
Sorry it's past your bedtime, Charles.
Then again, beauty sleep ain't fixing that.
What the hell are you doing here? You know why I'm here.
William Sutter.
- Never heard of him.
- Well, that's funny.
Because he transferred in here the last six months of his sentence and then you became an informant for Andrew Malik.
Oh, that William Sutter.
What about him? I want you to admit you set this whole thing up.
All right.
Nobody in prison ever admits to what they've done, but Sutter did.
- Because he knew he was dying.
- That's right.
He told me some asshole sold him out.
And wouldn't you know it? That asshole turned out to be you.
Took me awhile to figure out that you and Cahill were in on it, but once I did, I started looking around for somebody who hates you as much as I do.
So yeah, I did this.
[BREATHES HEAVILY.]
What you gonna do about it? Not a thing.
Because when I win, whatever deal you cut with Malik is gone.
Then again, if you said you made this whole story up, Cahill might just cut your sentence in half.
So you need to ask yourself who's coming out on top: Malik or me? The side I am on is always gonna be the side that's against you.
Louis.
- How much did you hear? - Enough.
I wanted to tell you what was really going on, Katrina.
I just couldn't.
I understand, Louis.
But what I think what you may not be understanding is that right now, Esther isn't just feeling angry.
She's feeling powerless and ashamed.
- But she has the power.
- To do what? She can't put him in prison.
It was too long ago.
Make him feel like what he did was wrong? That's never going to happen.
Louis, what Esther wants is for us to find a way to stop this without telling anyone.
Well, then let's do that.
Faye won't let you take your sister as a client.
Bullshit.
she's already a client.
No, the company is our client, and the board wants this merger.
Esther doesn't.
[STAMMERS WORDLESSLY.]
What are you saying? I'm saying we need help.
Sean, tell me you got Malik's boss to call off the dogs.
Call off the dogs? I haven't even gotten to him yet.
What are you waiting for? An engraved invitation? I just can't put pressure on a man I haven't met with without having someone soften him up first.
And being under indictment isn't the best time to be calling in IOUs.
Screw the timing! Sean, you need to have those calls made tonight.
Harvey, what happened with Forstman? He didn't go for it, and Kevin won't recant, which means if you don't make this thing go away, we're going to trial staring down the barrel of a loaded shotgun.
So get it done.
All right, Sean, what's this about? Because you're on leave and I shouldn't even let you in here.
I need a favor.
If it has anything to do with your case, I can't help you.
I need you to go to Andrew Malik's boss's office and read him the riot act anyway.
- About what? - Tell him it's nothing more than a personal attack against Harvey Specter.
And when he tells me I'm full of shit and I've got no proof, - then what? - Tell him to check the record.
Malik hated Harvey.
He went after him three times.
And if that's not enough, if Malik's not hiding a grudge, why the hell didn't he go after Harvey? Okay, I'll do it.
But Sean, did it ever occur to you that the person who put you in this position isn't Andrew Malik? It's Harvey Specter.
Donna Paulsen.
I should have guessed Harvey would send you here.
He didn't send me anywhere.
In fact, I'm putting my feelings about you aside to try to end this thing.
Oh, this ought to be good.
Go ahead.
Give me your song and dance.
It's not a song and dance.
This thing that you have with Harvey, it's consuming you.
And if you can't figure out a way to let it go, - it is not gonna end well.
- First a threat.
How about you move on to begging? I'm not threatening you, Andy.
I'm warning you.
You've come after Harvey twice before.
You lost and he let it go.
Well, he's not gonna let it go this time.
- I'm not gonna lose.
- Yes, you are, because you're not just fighting Harvey.
You're fighting all of us.
I appreciate the warning.
But you go home and you tell Harvey that he better sleep well while he can.
You're gonna have to tell him that yourself.
I'm not gonna see Harvey tonight.
He's too busy kicking your ass.
Samantha.
Glad you could make it.
- How you doing? - I'm okay, Louis.
But you sounded upset on the phone, and I'm sure you didn't bring me here to talk about me.
So what's going on? It's my sister.
She's being forced out of her own company by the man who assaulted her.
And she begged me not to confront him with it, but, of course, I did.
Let me guess: he's denying it.
He is.
And sure as we're sitting here, if you go after him, he'll admit it happened but say it was her.
- How do you know that? - Because I've seen this movie before, which is why I know he's made this movie before.
Well, let me tell you the movie I've seen.
What you and I did to my mugger.
What are you saying? I'm saying that I don't care if this guy has a family or not, Samantha.
You do whatever you it takes to take this piece of shit down.
Can I come in? I always forget what beautiful taste you have.
- Can I get you - I'm sorry, Esther.
You trusted me.
I didn't contain myself.
And I am sorry.
Thank you, Louis.
Thing is you hear about this kind of thing happening and you know it does, but you always think it happens to other people, not the people that you love.
And I do love you, Esther.
I know that, Louis.
[SIGHS.]
I love you too.
It's funny; it seems like you hear about this kind of thing now.
But back then, you didn't.
And you wondered, was it your fault? Was it something you did or said? It wasn't.
I just wished you had told me at the time.
Maybe I should have.
- The truth was - You were feeling ashamed.
Listen, I didn't just come here to apologize.
I know you said to leave this alone, and I'll call it off if you want me to, but I went to get us some help.
[SIGHS.]
Thank you, Louis.
You think you can go over my head and there won't be any consequences? I think you wouldn't be here if your boss hadn't put the screws to you - for coming after me.
- You're right.
He called me at midnight in my home and said that if I had nothing to hide, why the hell didn't I come after you? Well, you wanted it? You got it.
You are under arrest for conspiring with a federal prosecutor.
You're making a mistake, Malik.
What do you think the judge is gonna say when he finds out you arrested your opposing counsel? He's gonna say, "Guilty as charged", because I'm not just gonna disbar you.
I'm putting you away.
I wanna call my lawyer.
[PHONE CRUNCHES.]
Officer Haskins has butter fingers.
I'll see you down there.
We'll try to reach out to your lawyer on the way.
You hungry, Harvey? After I picked you up, I realized that you may not have had breakfast yet.
Well, since you're asking, I'll have two eggs, a coffee, and a side of kiss my ass.
Swagger, huh? But you're not fooling anyone because I know exactly how screwed you are.
What I know is I asked for my attorney; you smashed my phone, which means I could tell you I killed Kennedy, and it wouldn't be admissible.
Well, if you won't talk to me, maybe Sean will.
You know, we picked him up right after you.
You can't do that.
He's already been arrested.
Not for obstruction, he hasn't, which is exactly what happened when his boss went to my boss.
Oh, I get it.
You concocted this little prisoner's dilemma to get us to cave.
Well, if you think it's going to break us, you're wasting your time.
I think Sean Cahill has one chance to save his career, and all he has to do is turn on you.
Or you could turn first.
Be my guest.
In the meantime, I'm gonna go and see if Sean feels any different.
Alex, I need to talk to you.
Harvey and Sean were supposed to talk strategy this morning, but they're not in his office.
- You checked the conference room? - I did, and after that, reception, and it turns out neither of them showed up.
And when I call Harvey, it goes straight to voicemail.
Donna, they probably had the meeting over coffee and didn't wanna be disturbed.
Alex, I don't get this feeling very often, and you don't know Andy Malik like I do.
I'm telling you something's wrong.
All right.
Let's get to it, Sean.
I know you did this.
I know why.
You owed Harvey Specter your career.
- The hell I do.
- Oh.
You're gonna tell me that he didn't take down Eric Woodall, which puts you in your job and that's why he got his buddy out of prison? - Those things are unrelated.
- Wow.
That'd be the first time in history that both hands are clean and one didn't wash the other.
You need to get your facts straight, because the deal that I made to take down William Sutter Was with Mike Ross, not me.
Then why did you pursue Sutter as a client? His son-in-law, Kevin Miller, got Mike Ross out of a jam.
I owed him one.
And Kevin Miller says that's a lie.
And that's the coerced testimony of a convicted felon.
You think that's all I got? Phone records.
Two dozen conversations between you and Sean during that time.
- How do you explain that? - Frank Gallo was in there.
He was a danger to Mike Ross, so I called Sean.
Bullshit.
You want to get an inmate moved, you talk to the warden, not an SEC prosecutor.
Mike's life was threatened.
I was talking to anyone who'd listen.
Bullshit again.
Mike Ross was in danger.
You couldn't get Gallo moved.
So you had to get Mike out of there, and that's when you went to your buddy Sean and made a deal, which he took because he owed you.
- I didn't fucking deal.
- Yes, you did! I know the whole story.
I can tell it, I can prove it, and a jury's gonna believe it.
The real question is, which one of you two is gonna figure that out first? Not me.
Look at his track record.
Mike Ross went to prison for him.
Jessica Pearson lost her license for him.
He manipulates people! I didn't manipulate anyone.
You manipulated the law! You crossed the line at every turn! You think the rules don't apply to you.
- I'm good with who I am.
- That's the fucking problem.
You pursued a client with the sole purpose of putting him away.
You did it, you know it, and you don't even care.
Sean, do you know what happens to prosecutors who go to prison? This is your last chance.
Now you won't go to trial.
You won't lose your job.
All you have to do is admit the truth and this will all be over.
It is over, Malik.
My clients are done answering questions.
Yeah, well, I'm done asking.
Oh, and you don't have clients, Mr.
Williams.
- You just have him.
- What the hell does that mean? It means Sean Cahill asked for new representation.
- Who? - Faye Richardson.
She advised her client to take my deal, and he agreed.
[DRAMATIC MUSIC.]
First Harvey, then Louis.
I'm seeing you people more than I did when I was at the firm.
Speaking of the firm, I know Louis came to you for help with Esther.
Whatever you're doing, I want in.
Katrina, don't take this the wrong way, but go back to work.
I'm not going anywhere.
Then don't, but the reason he came to me is because I am doing things you can't.
Samantha, I was a prosecutor for six years before I got to the firm.
One day, a woman came in, said she'd been assaulted by her boss.
Let me guess: nobody believed her.
No.
Everyone believed her.
I threw everything I had at this guy.
I put her on the stand, she told her story, and then I had to watch as 12 jurors exonerated that bastard.
So if you're going after this guy, you're not doing it without me.
Harvey, before you say anything [GRUNTS.]
Fuck you and the horse you rode in on! Oh, you son of a bitch.
He had us.
We were gonna lose.
We were both gonna go to prison, and I cut us a deal - so neither of us would have to.
- What do you want, Sean? Do you want me to throw you a ticker-tape parade? I don't give a shit what you throw me.
You did what he said.
You went after a guy, made him trust you, and you threw him in prison for the rest of his life and you didn't lose a minute's sleep over it.
Yeah, he threw that at me too.
I'm just a piece of shit who only cares about himself.
And yeah, I colluded.
But I did it to get a man who never hurt a soul away from a convicted murderer who was gonna kill him.
- That doesn't change the - No, let me tell you something else.
My whole life, I've done what I think was right, but there's always someone somewhere who hates me for it because they think I'm breaking the rules.
Well, rules aren't right or wrong.
Every line I've ever crossed, I'd do it again because I am fine with what's in my soul.
Look, Harvey, I didn't say you were the bad guy.
I just said he had us.
Well, you know what, Sean? Now he only has me.
How could you do it? How could you betray Harvey like that? - I didn't betray anyone.
- Bullshit! You went to Sean and you helped him cut a deal to get Harvey disbarred.
He decided to take a deal, Donna, and when he did, Andrew Malik recommended me because Sean had a right to an attorney who was looking out for his best interests.
That right there.
That's what you do.
You hide behind morality when the truth is you just can't stand Harvey.
I don't hate Harvey.
In fact, I believe, in his heart, he thinks he's a good man.
That's why he won't change and why he's a cancer to this firm.
You call him a cancer? Well, unlike you, Faye, people love him.
Which makes the problem worse because you all follow him anywhere.
And if you think, you'll always be able to make him do what's right, - you're kidding yourself.
- Well, you know what, Faye? It was his moral code that kept him from turning you over to the Bar when he had the chance.
So next time you wanna talk shit about who he is, you think about that.
Six women over ten years.
The problem is none of them are willing to talk.
I can see why.
Violating those NDAs is a one-way ticket to bankruptcy.
Only in civil court.
The NDAs don't apply if it's criminal.
Then they'd have to take the stand, and if Esther won't do it, why would they? They won't.
[SIGHS.]
Damn it.
All we need is one.
Wait a second.
What if we're looking at this the wrong way? What do you mean? We can't ask any of these women to risk their life savings to come forward, but the people who arranged those NDAs are a different story.
They already risked their life savings because they took part in a cover-up.
Katrina, they're Paul's lawyers.
- They have attorney-client privilege.
- That's the thing, Samantha.
Their client isn't Paul Richmond.
It's the company.
And if they took action which gives their company exposure They have liability too.
It's a stretch.
Whoever it is won't just cave.
Unless there's more than one, in which case We pit one against the other.
[SUSPENSEFUL MUSIC.]
Ms.
Bennett, you said you wanted to talk about - a business opportunity? - That's right.
I'm offering you a chance to cut ties with Paul Richmond before it's too late.
- Why would I cut ties with Paul? - You know why.
Because you were party to buying the silence of the women he assaulted.
If Paul Richmond assaulted anyone, I never heard about it.
You never heard of Maya Perez or Janet Tundermann or any of these other women? I deal with hundreds of employees, Ms.
Wheeler.
I don't remember every one.
Then let me jog your memory.
You cut them bonus checks worth ten times what they were earning.
Not only that, every single one of those deals came with strings attached, and we know what they are: NDAs.
Because those payouts weren't released until the truth was buried, and you're one of the people holding the shovel.
- This conversation is over.
- Maybe it is.
But you might want to check your contract.
It says you work for the company, not Paul.
Which means any arrangements you made against Mayfield's interests are not protected by attorney-client privilege.
So the question is, who's going to talk first? Were you gonna tell me about Cahill or was I supposed to read about it in the "Journal"? I'm sorry, Donna, I didn't have it in me to tell you.
I get it.
You were loyal to Sean, and it was a gut punch.
And now Malik's finally gonna get what he wants.
Cahill and Faye are taking that plea deal, and I'm gonna lose my license.
And the Harvey I know wouldn't give up until they yanked him out of here.
And that's gonna happen tomorrow because as soon as Cahill signs that thing, Malik's got me.
No, he doesn't.
And if I'm right, he's not going to.
What are you saying? After I bailed Harvey out, I pulled the arrest warrant.
Turns out, the time on it was 9:00 p.
m.
, two hours before Cahill's boss went to Malik's.
And exactly one hour after I saw Forstman.
Shit, he didn't arrest me because Cahill went over his head.
He did it because he knew I was getting close to something.
Which leads me to this.
Sutter's autopsy.
He didn't know he was dying.
He died of a heart attack on the spot.
Which means Forstman wasn't telling the truth.
But he was telling the truth.
He had to have gotten the story from Sutter.
Otherwise, how did he know? See, that's the thing.
He wasn't lying about what Sutter told him.
He was lying about when.
Malik's whole case hinges on Forstman's testimony.
And in order for it to be admissible, it had to be a deathbed confession.
And you can't give a deathbed confession without a deathbed.
Which means Sutter must've told Forstman, but Forstman didn't put it together about Cahill until it was too late.
So this means you're off the hook.
We've got proof.
Maybe, but I don't just want proof that Forstman was lying.
- I want proof that Malik knew.
- How are we gonna get that? By giving Sean Cahill a chance to make things right.
Samantha.
I hope you don't mind.
Sheila let me in.
No, of course not.
What do you got? Good news and bad news, Louis.
We have a road map to every time Paul has done this before and the settlements he's paid.
The thing is, we still don't have a plaintiff.
And without a plaintiff, the best I can do is bluff.
That's what I'm here to say.
You'll have to convince your sister to come forward.
No.
Samantha, I can't.
She doesn't want to do it, and I can't ask her again.
Then I think I know who can.
[DRAMATIC MUSIC.]
Katrina? I got your message.
I came as soon as I could.
Esther, please sit.
I know we've only met once or twice, but I'm going to have to redirect because we don't have much time.
We were able to find a substantial amount of evidence against Paul throughout his career.
But? But without someone willing to come forward, you're going to lose your company and he's going to keep doing this.
I see.
Before you say anything, I want you to know two things.
I once took up this fight for someone in your situation.
And we lost.
I called her today, asked if she regretted coming forward, and she said that, while living with that verdict was hard, not having said anything would have been harder.
And the other thing? That case was nine years ago, and Esther, times have changed.
I'm not so sure they have.
Obviously, this is your decision.
But, as I said, we don't have much time.
What the hell is this? Where's Faye? Faye's not coming 'cause Sean is not signing your deal.
Well, then, I guess we're going to court.
No, Malik.
You're going to court because we didn't conspire with a convicted felon, - You did.
- The hell are you talking about? He's talking about the fact that Charles Forstman lied about the timing of Sutter's confession.
And you're the one who told him to do it.
I can't believe this.
You can't see what happening here? He's spinning you.
That's what he does.
You call this spin, Andy? I call it evidence.
You pulled my records, I pulled yours.
All your contacts with Charles Forstman.
Every single one, including the phone call he made to you five minutes after I left him, warning you we were getting close.
Not to mention the deal that you cut with him three months after Sutter died.
And there is no record of any contact between you and Charles Forstman before that.
You think you can intimidate me into dropping this? No, Andy, I don't.
And we're not intimidating.
We're arresting.
You're hereby charged with fabricating evidence - in a criminal case.
- The hell I am! I'm the goddamn state's attorney! No, you're not.
See, Donna told you this would happen, and now it is.
Remember what you said about prosecutors who go to prison, Andy? Well, you're about to find out.
You're not going to get away with this.
We just did.
That was close.
I guess it's a good thing we stuck together till the end.
Sean, I understand why you did what you did.
You do? I'm always saying loyalty is a two-way street.
If I can't see that you were trying to do the best for both of us, then I'm an asshole.
You said it, not me.
Bet you know what I'm gonna say now, huh? Something about you never wanting to see my face again? Something like that.
Wanna grab a beer? Let me take a rain check.
I've got a little errand to run.
Go get him, Harvey.
I assume you're here to sign the deal on behalf of your client? I'm here to end this thing.
And what are you going to accuse me of this time? Hmm? Robbing Fort Knox? Here's the thing, Paul.
We went to two of your people, gave them the choice between saving your ass or saving themselves.
Take a guess whose ass they didn't save.
Every NDA, every dirty deal, every single cover-up.
This is nothing but, uh, proof that these women signed confidentiality agreements.
Doesn't mean what they're saying is true.
We'll see what your board has to say about that.
I don't think the board's gonna say anything.
You know why they won't? 'Cause Esther won't come forward.
No one comes forward; you got nothing.
No, Paul.
He has everything.
[INSPIRING MUSIC.]
You know why I wasn't gonna come forward? Because I didn't think people would believe me.
But when I tell my story, you can bet your ass I am gonna make them believe me.
Even if they do, it's long past the statute of limitations.
Not to sue your ass, it isn't.
Which is why you're gonna resign.
And if you don't, I am gonna tell the world how, when I was 28 years old, you lured me to your room, put your hands all over me, and when I resisted, you overpowered me.
And when I finally got away, you told me if I ever said a word, that I would never work again.
And when she's done, they're not gonna throw you in prison, but they're gonna take away every penny you have.
Sign! [DRAMATIC MUSIC.]
Now get the fuck out of here before we change our minds.
- [SIGHS.]
- You okay? I I am.
I didn't know you were gonna show up.
Neither did I.
Oh, I couldn't have done that without you.
[CHUCKLES.]
If you're here to up your offer, save yourself the trouble.
I'm not cutting a deal with Sean Cahill.
I'm not here for that, Charles.
I'm here to tell you that we know you lied, and we know Malik was in on it.
I don't know what you're talking about.
Then ask him, because my guess is he'll be joining you here in six months.
I'll be out in two years.
We'll see what happens then.
There isn't going to be a then.
You perjured yourself which means your time here isn't going down.
It's going up.
Don't worry.
The guy who decides how much is Sean Cahill.
[FINGERS SNAP.]
I'm sure he'll take it real easy on you.
Hey.
How did it go? Well, we didn't convict him, but short of that, it went as well as possible.
Ah, that's great, Louis.
It feels weird to say that I'm happy in a situation like this.
But I am.
I'll call Esther tomorrow.
That would be nice.
- Hey, are you okay? - I am.
It's just Sheila, I've been thinking about family how important it is to me, how important it is to you.
What's going on, Louis? Well, I know you're far along, and I know it may not be how we would have planned it, but I want to get married before we have the baby.
Are you serious? Louis, I look like a house.
I do not care what you look like.
I want us to be a family.
And I never gave you a ring.
And I know we're already engaged.
Sheila [GENTLE MUSIC.]
Will you marry me before you give birth to our child? Yes, I will.
[DOOR SLAMS SHUT.]
It's done.
You should have seen the look on Forstman's face.
In fact, I don't know which was better his or Malik's.
Harvey, I need to tell you something.
What is it, Donna? What's wrong? Your mother had a heart attack.
She's gone.
