Waco: The Aftermath (2023) s01e03 Episode Script

The Gospel According to Livingstone Fagan

1
[INDISTINCT CHATTER]
[VERNON] When you look
at Isaiah in relationship
to the New Testament,
you get whole new interpretations of it,
don't you?
For example, Jesus wasn't the messiah.
He was a messiah.
He wasn't even the first,
and sure as heck won't be the last.
Messiah comes from
the Hebrew "Mashiach."
Who here knows what that word means?
"An anointed one."
Good.
And many were anointed.
King David, Noah, Daniel.
There are dozens of messiahs
in the Old Testament.
But, but the word means more than that.
A messiah is a savior, a liberator.
"One lamb you shall offer in the morning
and the other lamb you
shall offer at twilight."
Meaning [SIGHS]
there are only two messiahs.
Yashua, or Jesus the Christ,
and the Lamb,
who will open the scroll.
[VERNON] Exodus 29:39.
Two Messiahs
not dozens.
So you think the next
time we see a messiah,
it will be the second lamb who
will open up the seven seals
and usher in the end of the world?
I guess that depends on
how you read Revelation.
[VERNON] What's your name?
Livingstone.
Well, Livingstone,
you're an obstinate
son-of-a-gun, ain't you?
- [PEOPLE CHUCKLE]
- [CHUCKLES] You have no idea.
[VERNON] You know, it's
rare I speak to someone
with such deep
understanding of scripture.
[CHUCKLES] I feel like I've learned more
in the last two hours with you than
[CHUCKLES] in the last
two years at this college.
- [SIGHS]
- Well
it seems to me like you
know what you need to do.
And what's that?
I got a place in Texas
where there's a whole group of us.
We study scripture together,
and we follow the rules
set out by the Bible.
It's a pretty great life.
You should join us.
We could use someone like you,
the mind of a theologian.
To Texas?
Sometimes God has bigger plans for us
than we could ever dream up ourselves.
Tell you this, just come for a visit.
See if you believe God is there.
[CHUCKLES]
[VERNON] After we were
forced out of Mount Carmel,
we didn't know where to go.
We were a lost tribe like
those mentioned in 2nd Kings,
being tested by God.
And then we found this place,
a place to heal and rebuild.
We call it New Palestine.
This is right here is where
we have our church services.
Nothing too fancy, but we get by.
Uh, you're living in a
real Christian commune,
like the Bible teaches.
Is this Livingstone?
Welcome! Uh.
[LAUGHTER]
Vernon says you are the
smartest man he's ever met.
Oh, I've spent a lot of years studying.
- You're Australian?
- [CLIVE] I am.
Yeah, we've got people here
from all over the world.
People like you who have
been called to this place.
So, uh, good news,
Lois rang this morning.
She's accepted your
invitation to Passover dinner.
Really?
Maybe she's ready to bury the hatchet.
Well, that's good.
That's really good.
You're in luck.
Came here in an exciting time.
Welcome to the Promised
Land, Livingstone.
[CORRECTIONS OFFICER] Get up.
[INHALES DEEPLY]
Why?
[CORRECTIONS OFFICER] You
gotta be strip-searched
before you can go exercise
in the yard, same as every day.
Fine. I won't exercise, then.
[CORRECTIONS OFFICER]
Well, that's not up to you.
Get up.
I said get up.
And I said
I will not.
[THEME MUSIC PLAYS]
I met some oddballs in
my time, but none of them
ever followed me into
the men's room before.
[ROCKET] Not unless
you were paying them.
The guy was kind of making
sense by the end though.
[DOUG] What's this guy's name?
Uh, the card said, uh, "Noh-vel"
or Novel, or I don't know.
Gordon Novel?
Oh, he's the real deal.
Yeah, he's, he's CIA from way back.
- Bullshit.
- [DOUG] No, really.
You know that photo of J.
Edgar Hoover wearing a lady's dress?
- Novel leaked it.
- [CHUCKLES] Stop.
[LAUGHS] Hey. Man's
crazy, but he's connected.
I wonder how he got it.
[JOE] Hot off the presses!
Ah.
Monday's discovery list.
Oh, shit.
What?
Jamie Helliver.
They're putting him
on the stand on Monday.
Helliver is the ATF agent
who claims Livingstone Fagan
shot him, our first
eyewitness to attempted murder.
Says two white guys and
a Black guy shot him.
Can't ID the white guys,
but what do you know,
the one Black guy that survives,
that's the one who shot him.
Tell me that's a coincidence.
I won't, but I will tell you
we're not gonna win
painting the ATF as racist.
- You don't know that.
- No, I do know that.
You never win these things
from up on a soapbox.
This can't be about race. Not in Texas.
No, we just need something we can use
to plant some shred of doubt
in the jury's mind and then move on.
Take our lumps on this one. That's it.
Yeah.
So, who's doing the cross?
Helliver is going to ID my client.
- My client, my witness.
- [DAN] It's just
you can get a little
emotional up there, Rocket.
Look, y'all keep saying
we're a team, right?
- Well, that means you guys gotta trust me.
- No, we do trust you.
But maybe I can help you prep.
All right? Now, let
me ask you something.
What does Livingstone say
about Helliver's claims?
[SIGHS DEEPLY] Nothing.
All he ever does is quote Bible verses.
Doesn't know how to help himself.
Well then, maybe we should
head down there tomorrow
and have a little chat, see if
we can't shake something loose.
We?
Good morning, Livingstone.
We need to talk to
you about what happened
on the first day of the siege.
I told you, I have no
interest in discussing that.
You have no interest in being acquitted?
[SCOFFS] I won't be acquitted.
How do you know?
Because I've spent the better
part of my life studying the Bible.
Never ends well for apostles.
[SIGHS] They're trying to silence us
because they know we're
speaking the truth.
No, there's no conspiracy,
it's a Federal trial.
There's always a gag order.
Look, you need to fight this thing
- in a courtroom and not through theologians.
- I will not.
So you're just gonna
let them run over you?
They've already rolled over me!
- Okay.
- You seem to be the only one
- who doesn't see that.
- I'm sorry.
That's what they want. They
They want me to
fight back,
so they can smile as
they watch me suffer.
But
I will not give them that satisfaction!
They've killed everyone I love,
but I will never let them see me suffer!
Okay.
Never.
I appreciate what you're trying to do.
I don't mean to be obstinate, but
[INHALES DEEPLY] I
don't have a lot of time.
The Romans are coming.
The Romans?
St. Paul, who spread the word of Christ,
he was beheaded by the Romans.
Okay. Well, I feel like we're
getting a little off topic here.
Hey, wait a minute, wait a minute.
Didn't St. Paul ask for an appeal?
- What?
- [DAN] Yeah.
You know, after he was thrown in prison,
he appealed his case to the Caesar?
You're a biblical scholar now?
No, 12 years of Catholic school,
I hated every minute of it.
So boring. No offense.
What's your point?
[DAN] That even the Apostles
played the legal game
when it suited them.
Paul bought himself time.
He preached for another couple years,
gained followers,
spread Christ's message.
Look, Agent Helliver
is gonna get up there
on Monday and tell
the jury you shot him.
So we just need something we can use
- to argue that isn't true.
- It's not true.
You didn't shoot anybody?
I didn't say that. I'm saying that
Look, I didn't shoot him.
[DAN] Well, we can't
really say you were too busy
shooting other people.
Probably not a winning alibi.
[ROCKET] Can you provide
us with any more details?
[CHUCKLES] I don't know what, what,
what else I can tell you. It
it was chaos.
[GUNSHOTS]
Well, Helliver says he
was on the north side
when the firefight started.
Says you shot him within the first
couple minutes of the exchange.
I was never on the north side. I
When it started, I was on the
opposite end of the building.
Peter had been shot and I
[GUNSHOTS]
I was trying to help him
away from the window
before I realized he was dead.
You moved the body by yourself?
No. Clive helped me.
You were with Clive
when Helliver was shot?
My Clive? Clive Doyle?
- Yeah.
- Well, hallelujah!
We got ourselves an alibi.
[SIGHS] I don't even know
what you're looking for.
Everything we have on Elohim City.
What about this?
Who's Richard Snell? Do you know?
[JIM] Yeah. Why?
It says here Pappy Millar
is his spiritual advisor,
visits him in prison regularly.
I do remember Snell.
Bingo.
- Huh.
- [GARY] Huh.
[JIM] "Member of the Covenant,
the Sword, and the Arm of the Lord."
He frequented Elohim City.
Currently on death row in Arkansas
at Cummins Unit Prison for
killing a pawnshop owner
he believed to be Jewish.
- Spoiler, he wasn't.
- Hmm.
He also killed a black cop.
Who do we know at Cummins Unit Prison?
[JUDGE SMITH] What's this about?
We'd like to make a
request to sever my client,
Livingstone Fagan's
case from the others.
On what grounds?
[ROCKET] On the grounds
that my client has an alibi
during the time Agent Helliver
claims Mr. Fagan shot him.
- [JUDGE SMITH] Alibi?
- Yes, my client,
uh, Clive Doyle, Your Honor.
[JUDGE SMITH] I'm not gonna
waste the public's time
and money trying this
case more than once.
This is a conspiracy case.
Defendants can't testify
on each other's behalf.
- It's self-serving.
- Wait, wait, wait.
What do you mean self-serving?
Of course it's self-serving.
Every person I put up on the
stand is self-serving for my case.
- That's why they're up there!
- Okay. Okay.
Your Honor, the we, we
there is a legal precedent
I don't give a fig about your precedent.
I'm not going to let his best buddy
and co-defendant give him an alibi.
Motion denied.
[CLIVE] Vernon, they're here!
[CAR HORN HONKS]
They're here. [CHUCKLES]
- Oh, so good to see you.
- [INDISTINCT CHATTER]
Vernon.
- Come here.
- [CHUCKLES]
The story of Passover
tells us that the Israelites
were enslaved to the Pharaoh.
That Moses delivered
them from that slavery.
But that the Jews wandered the desert
for 40 years before being
delivered to the Promised Land.
And now all these years later,
we find ourselves like the Israelites,
living in Biblical times.
And like the Israelites, we
also find ourselves wandering,
waiting for the Lord to tell us
how we can help deliver ourselves
and our families back
to the Promised Land.
Well
you won't have to wait much longer.
I've invited Vernon back to Mount
Carmel under my guidance. [CHUCKLES]
Well, Lois, that's mighty kind.
I do want to return to Mount Carmel.
I really do.
And one day I will. God
has promised me that.
But not under the rule of the Pharaoh.
What are you talking about, Vernon?
[VERNON] Look what's happened to
Mount Carmel under your guidance.
It's falling apart.
Does anybody look at Mount
Carmel right now and say, "Wow,
God has blessed this place"?
Or do they look here, in these woods,
at these passionate believers,
and see that this is where
God has chosen to stay?
God has left you, Lois.
And I can't bring Him back to you.
Look around,
He's here with us, just
like He was with Moses.
We will return when the time is right,
but not when you tell us.
You bastard.
[VERNON] I am the Lamb,
the Lion of the tribe of Judah,
the root of David.
No. No, you're not!
You are the serpent!
Come on.
Ruth?
I think I'm gonna stay here for a bit.
I'm sorry. [CRIES]
[DRAMATIC MUSIC PLAYS]
I'm starting to feel like an idiot.
The guy was supposed to
be here 15 minutes ago.
Are you sure he's legit?
Legit?
No, he's a maniac, but we're desperate.
- [TIRES SCREECHING]
- [ENGINE REVVING]
Get in.
[ROCK MUSIC PLAYS]
Shotgun.
I don't think I was being followed,
but you can't be too careful.
I didn't think I was
gonna hear from you.
Yeah. Well, uh, Gordon,
things have changed.
We're in a little bit of a bind
with some upcoming testimony.
Whose? Agent Helliver's?
- Uh, yeah.
- [CHUCKLES]
Yeah. Looks like you were right
about those front doors being metal.
Figured we could see if
we could get a little help.
The door is just the tip of the iceberg.
There's a much bigger story with Waco.
- Much bigger.
- [DAN] Eyes on the road there, boss.
Here. Look at this.
Did you know that the
Davidians, that none of them
had a proper autopsy because
the morgue lost power?
- [ROCKET] Oh God.
- Or Jimmy Riddle?
Dragged back into the
fire after he was shot,
arm ripped off by a tank.
Wonder who murdered him? Hmm?
Gordon, let me ask you a question.
What's in this for you?
Why are you so hell-bent
on digging up dirt?
Because I hate the ATF with the
fire of a thousand suns, that's why.
- I'm getting there myself.
- [DAN] Yeah, but why?
Because they arrested me
four times for fire-bombing
the Federation of Churches
building in New Orleans, that's why.
Which you didn't do?
Oh, no, I did it, but it
was a misunderstanding.
I just wanted to get the
- World's Fair to New Orleans.
- Okay. Yeah. Pull over.
Pull the car over.
[ROCKET] No. Nuh-uh.
Oh, no. [GRUNTS] Oh,
no. Oh, God. Get me out.
I think it's best if we just
don't tell anybody about this.
First one went in here, the second here.
You can see where the bullets hit.
[BILL] And those holes
correspond to your wounds,
- as far as you can tell?
- The ones on my chest, yes.
Uh, two other shots went
through my arm and my shoulder.
The second was on its way out
when it hit the back of the
vest, went into my chest.
The vest appears to be discolored.
What is that discoloration?
Blood.
My blood.
- [BILL] Now, you've described
- [WHISPERS] Hey. It's Novel.
what happened to you
in those first moments.
Do you have any doubt
as to whether or not.
Defendant Fagan shot you?
[JAMIE] No.
There's no doubt in my mind
that man shot me.
Gordon, we're in the
middle of a trial here.
I did some digging into Agent Helliver.
Found something.
What am I looking at here?
This is the lineup card
that the Texas Rangers
showed Helliver when they
asked him to ID Fagan.
Read the notes in the margin.
Is this real?
Got it from a Texas Ranger.
Crazy son of a bitch.
How do we even know it's real?
Hmm, fair question, do
we have anything to speak
to the veracity of this document?
I have a signed affidavit from
a Texas Ranger saying it is.
Hmm. Uh-hmm.
I withdraw my objections.
- Great. Thanks, Bill.
- [JUDGE SMITH] Admitted.
Is this the circle you drew
around Livingstone Fagan
to ID him as the man who shot you?
It is.
[ROCKET] When was this interview?
Um, believe it was in
the summer, June or July.
So at least five months after the siege.
- [JAMIE] Yes.
- [ROCKET CHUCKLES]
That's a long time.
Hey, can you read what the officer
who took your statement
wrote in the margins here?
[JAMIE] "Unsure if ID
is from shootout or TV."
So, you weren't actually sure
that Livingstone Fagan
was the man who shot you.
Well, um
the, uh, picture is blurry,
that's why I was unsure.
I know who shot me.
How many Black people
lived at Mount Carmel?
Do you know?
No.
Uh, White, Black, Hispanic,
I just knew that there
were people there.
You remember saying that two White men
and one Black man shot at you?
[JAMIE] Yes, shot at me.
Livingstone was the only
one who actually hit me.
But you never identified
the White men, did you?
- No.
- So the only person you ID'd as a shooter
happened to be the only
surviving Black guy?
I guess so.
And is it true that
your ATF Field Office
has recently been sued
by its own Black agents
for creating an unsafe work environment?
It was not unsafe.
The Black agents were,
uh, offended by some jokes,
- that's all.
- Right.
Like the framed certificate
on the wall that said.
"Negro Hunting License"?
Like that funny joke of yours,
you racist son of a bitch?
- Objection!
- Watch yourself, counselor.
[JAMIE] I'm not a racist.
And you can call me names all you want,
but I am standing here
now, by the grace of God,
and I'm looking at that man right now
with my own eyes,
and I am telling you,
that's the man who shot me.
[RICHARD] Why are you here, Fed?
[GARY] Well, I, I'd like, if I could,
to learn more about Elohim City.
[RICHARD] Why would I
talk to you about anything?
You guys are putting me
down like a dog on April 19.
Do you know that date?
The significance?
You should.
It's the two-year anniversary
of the day you Feds
burned 76 innocent women
and children alive at Waco.
Were you there?
Oh, you were, weren't you? [CHUCKLES]
Do you hear their
screams when you sleep,
the children, those babies?
You know, Richard,
not that I owe you an explanation,
but I'm gonna tell you what
the problem at Waco was.
Okay?
On one hand, we had a selfish,
narcissistic cult leader
who wouldn't listen to a
goddamn thing anybody said.
And on the other,
we had some FBI leaders
who chose to take
an unfortunately aggressive approach.
But there is plenty
of blame to go around.
It wasn't all on us.
Do you think they would've
just killed themselves
if you didn't push them to it?
Guard?
I hope you still smell
their burning flesh.
Guard?
Because I sleep like a baby!
And when April 19th rolls
in, and I have my last meal,
I will imagine the
look on your ugly face
as you realize who we
are, how we punch back!
[LAUGHS]
[GARY EXHALES SHARPLY]

He said he'll be having his last meal

Well, that's odd,
seeing as he chose not to have a meal.
- Yeah?
- Yeah.
He said he didn't wanna eat,

On April 19th.

for Jimmy Hoffa now?

I don't know, like 8 ball, maybe.
120, but it's good.
Okay.
I'm good for that.
- I'll be right back.
- Okay.
[SINGER] Shove my nose in shit ♪
What's going on here?
- [MAN 1] Quarters.
- [MAN 2] Quarters.
Can I play?
[MAN 1] By all means.
Oh!
That was so close.
- Oh, shit!
- [MAN] Oh!
That's it. That's it.
All drink. All drink.
Oh, shut up, Carol. [SIGHS]
- Are you enjoying this?
- No.
Good, 'cause this is just stupid.
[CAROL] Becca. Becca,
over here.
All right.
- Thank you.
- Tell Wild Bill,
- I said, "What's up?"
- I will.
Hey, um
you know the other thing that
sucks about the whole situation?
I left a bunch of my shit
at his place at Elohim City.
You know how crazy they are
about letting people in and all that?
- Uh-huh.
- Yeah. You got a trailer there,
right? Right?
So, you know, maybe
you could vouch for me?
Just, just so I could get in, you know.
You know, like a woman
to woman kind of thing?
- I don't know.
- Come on.
I'm trying to avoid buying
a whole new wardrobe.
[CHUCKLES]
Okay. Yeah. Maybe we can
[GAMBLER] I'm not paying you shit.
I had to ask my uncle
redo the cash out to this shop.
[GAMBLER] That's bullshit.
Dude, no matter what,
- you owe me.
- [GAMBLER] I'm not trying
to Jew you out of nothing.
- Now, get the fuck out!
- Get back!
- [BECCA] Hey, hey, hey.
- Oh, shit.
- [BECCA] Put the gun away, man.
- Did she say, "gun"?
- [MAN] Stay calm.
- [GUNSHOTS]
Whoa. What happened to her mic?
Dispatch, this is Agent Gram.
[GUNSHOTS]
Alert local authorities
that there's been gunfire.
Come on, let's blow this shithole.
Come on.
Keep going. [LAUGHS]
Where is she going?
[ANGIE] What's happening?
[CAR ENGINE STARTS]
Shit.
[VERNON] You heading out?
Ah. I have to get back to my family.
Well, sure was hoping
you'd stay a little longer.
What is it?
I know what you meant the other night,
at Passover dinner.
The Lamb, the Lion,
the root of David.
Saying you're a Messiah.
You've been here for a few weeks now.
What do you think?
I never asked for this.
And I'll be honest, sometimes
it feels like a burden too great.
But I have been chosen.
And then I was led to you, Livingstone,
because you've been chosen, too.
You've read Revelation.
You know how this old story ends for me.
God has chosen you to tell
my story when I'm gone.
Why me?
Nobody understands my
teachings like you do.
[GEORGE] Where is he?
Where is that son of a bitch?
Hey! What's going on?
This is all your fault.
- You killed her.
- What?
- Killed who?
- [GEORGE] Mama!
- She's dead.
- [GRUNTS]
[GEORGE] You are never
coming back to Mount Carmel!
Never!
You goddamn rapist!
Are you okay?
It's already begun.
The forces of darkness
trying to snuff out the light.
Livingstone, God has asked you to stay
and to fight for that light.
[LIVINGSTONE] David is Messiah.
The lamb "was slain
and has redeemed us
to God by thy blood."
He will come again
in Judgment [COUGHS]
of the living and the dead.
And his name is David Koresh!
David Koresh.
The name of the lamb is David Koresh!
When he returns,
he'll bring the kingdom
of heaven to Earth!
The seventh seal will open!
He will slaughter the Babylonians
and the unbelievers,
pulling down the curtain on mankind!
The end days are coming.
[VOICE FADING] We will all witness
[ANGIE] She played you,
Gary. She's not gonna call.
- It happens.
- No. She's not doing that.
She's she's trying.
I know you wanna believe
that, but she's not.
Look, she gave me this letter
in case something went wrong.
Now, why on earth would she
do that if she wasn't serious?
I don't know.
Maybe you should give it
a read, see what she said.
"Hi, Dad. If you're reading this,
then I'm probably dead.
But if that's true,
it's only because I was
doing something right
for once.
I know I've been a real
disappointment to you and mom, but
if you're reading this, then at
least I died for something important.
Love, Carol."
What if in my blind drive
to make up for the fact
that 76 people died on my watch,
I go out and get another one killed?
The people in Elohim City are scary
and this could go very badly for her.
I'm gonna go home to my daughter.
Uh-hmm.
You heading out?
No. I'm gonna stick
around, see if she calls,
if that's okay.
Sure.
[CAROL] Hey, I, I know we
were just gonna pop in and out,
but I kind of need a place to crash,
so is there any chance
I can stay with you for a few nights?
Shit. We ain't even there yet
and you're trying to
burrow in like a tick.
You got a crush on me or something?
[CHUCKLES] No.
- You ain't my type.
- Oh.
I like assholes. [CHUCKLES]
Well, all right by me,
but you'll have to ask the big guy.
[GATE CLATTERS, CREAKING]
[CAROL] I don't remember
checkpoints last time I was here.
[BECCA] Yeah. They've been on high alert
since your Wild Bill
and his boys went down.
They have a second gate? [SCOFFS]
Yeah. This is where they, uh, search us.
Who the hell are you?
I'm, I'm with Becca.
- I was
- This is not what I asked.
Who the hell are you?
I'm Carol.
She's Wild Bill's girl.
Get out of the car.
Why?
So I can search you.
Hands up. You know the deal.
[CLATTERS]
Easy there, perv.
You guys really know how
to make a girl feel welcome.
[PAPPY] We do what we
can. [SPEAKS GERMAN]
Morning, Pappy.
How's training going
with the new recruits?
They'll get there.
Uh, that's my friend Carol.
She wants to see if she
can stay here for a bit,
crash in my trailer.
Nice to meet you, Pappy.
- [DOG BARKS]
- You're Wild Bill's girl.
That's right.
Shame what happened to him.
Yeah. It was messed up.
Yeah. It's just strange,
Wild Bill robbed 21
banks without a hitch.
And number 22, the cops were
right there waiting for him.
One of his boys was
probably running his mouth.
Nein.
Sitz.
My daddy raised Dobermans, you know,
beautiful dogs just like these guys.
Church is at noon.
I wouldn't miss it, Pappy.
