Diggstown (2019) s04e03 Episode Script

Previously on "Diggstown".
Judge Dewey, your openly
transphobic behaviour
is disgusting.
I hope to never see you
in my courtroom again.
After what I just told you,
do you think Judge Dewey
deserves to be on the bench?
Judge Dewey is accusing me
of professional misconduct.
Stay the hell away from my nephew. No!
I'm troubled to learn of the
government's callous disregard
for your niece's rights as a mother.
Therefore, I find
Ronnie Maloney not guilty
on the charge of kidnapping.
Basil's gone.
We were supposed to meet yesterday
but he he never showed.
I think I found him.
We are gonna find out
exactly what happened to him.
We are offering no evidence
in the criminal case
against the defendant,
Sister Mary Grace Locklin,
for the alleged abuses committed
at the Pine River Indian Day school
on the basis that there's
a lack of evidence
to proceed with the trial.
The elders told me not to
expect justice anyways.
I don't know what I was thinkin'.
Cal dismissed the charges.
Time for plan B.
I'm happy that the crown
saw through all those lies.
I put my faith in God and
I did expect this outcome.
We're gonna end it here.
Thank you, ladies and gentlemen.
It's been a very long week
for Sister Mary Grace,
so we're gonna wrap it up here.
Hang tight, folks.
Sister Mary Grace Locklin.
You've been served.
Mr. Dubois, will you be
fighting this in court?
Sister Mary Grace, can you
tell us what this is about?
Thank you, everyone. Thank you.
Please, no more questions.
There you go, there you go!
Atta boy, atta boy!
One, two, one, two!
Okay, switch it up! Switch it up!
Come on!

All right, all right,

Good work, bud. Good work, man.
Nice work.
Hey.
Good to see you.
Good to see you, too.
You're doing some great
work with these kids.
Yeah.
You know, it's, uh,
it's good to be using
my skills, you know,
for something good.
So, um, is everything on track?
Yeah, I was just checking in.
You ready?
I've been waiting for
this my whole life.
Donald, if we get this right,
if we get a win,
your case could inspire
prosecutors from here
and across the country
just to be brave enough
to pursue criminal charges
against all of these abusers.
It's for all of us.

Are you okay?
Yeah, no.
I don't know.
Is it about the stuff
around your birth mother?
No, it's not about that.
It's just, I keep waiting for
things to get back to normal
between us, but
I know, I know, I
I've just been really wrapped
up in my own head and I
But I'm back now.
Yeah, back to work.
Look, I'm sorry, um
Never mind.
Have a good day, okay?
Let's have dinner tomorrow.
A nice dinner just the two of us,
no phones.
Do you even know how
to turn off your phone?
- Hey.
- Hey!
Any news?
Well, uh, they sent me
her name and address
but she hasn't reached out.
Well that means
she didn't sign the declaration veto,
so you're free to contact her.
Yeah, I'm just
I'm just not so sure now.
Look, I get it.
You're afraid that the reality
of meeting your birth mother
won't match up to whatever
you got going on in here.
My advice?
Do whatever you want.
Whatever's best for you.
Avery, you don't owe
anyone else anything.
Look, we can't always get what we want.
But figuring it out,
it's a good starting point, you know?
Yeah, thanks.
Hey, you'll be fine no matter what.
Got it?
Yeah.
Got it?
Got it.
Okay.
The first of 699 Indian Day
schools in Canada opened in 1880.
The last one closing in 2009.
My client, Donald Christmas,
is among the estimated 200,000 victims
from across the country.
He attended Pine River
Indian Day school.
The evidence will show that
Sister Mary Grace Locklin
was vice principal of Pine
River from 1977 to 1991.
We will further show that she,
the very person responsible for
the well-being of the children,
initiated student-on-student violence
that was so emotionally
and physically damaging
that our client's trauma
continued right through his adolescence
in high school.
Eventually led to my
client's incarceration
into a juvenile detention
centre for the attempted murder
of an older student, Jason Bear.
A student that Sister Mary Grace
coerced into attacking
young Donald Christmas
for years.
We're here today to seek justice.
We're asking the court to
find Sister Mary Grace Locklin
guilty of incitement and
assault causing bodily harm.
Your Honour.
My client has been demonized
because of what's been
in the media recently
regarding this scandalous
legacy of residential schools.
This frail 86-year-old woman
is being used as the scapegoat.
Why place the burden of this atrocity
on one woman's shoulders?
What about the
administrators of the school?
Or the Indian agent who was stationed
on the Pine River reserve?
Yes, residential schools and day schools
should never have existed,
but the system is to blame.
Sister Mary Grace faithfully
performed her duties,
as instructed,
for nearly thirty years.
There is no case here, Your Honour.
My client is innocent.
What is a day school?
They were government funded,
church-run schools
located on First Nations reserves.
They had the same objectives
as residential schools,
to assimilate Indigenous
children into Canadian society,
and in most cases,
the same abuses took place.
Donald Christmas was identified
as a level two victim.
Can you explain to the
court what that means?
There are five levels
of abuse used to categorize
the suffering of the claimants.
And do these include criminal acts?
Yes.
Harm, assault,
assault causing bodily harm,
and sexual assault.
Does your research show
that these types of crimes
were committed at the
Pine River Day school?
Yes.
Thank you.
I have no further questions,
Your Honour.
You transported migrant worker
Basil Allen out of province
that is, you moved him from
Nova Scotia to Newfoundland.
Hi!
Hey, Lester.
Excuse me.
We met in P.E.I.
Where you failed to mentioned
you were a Clawford.
Couldn't you tell from
the family resemblance?
Mr. Clawford, we'd rather
not file suit against
you and your family business.
Suit for what?
Mr. Allen was on that boat
as part of his employment
with Goldenview.
He was under your care and supervision.
And at some point during
that journey he was killed.
According to the police,
Mr. Allen was drinking on
the boat and fell overboard
while alone on the deck.
You can prove this?
That's not our job.
If you have concerns about the
voracity of this investigation,
you should speak with the police.
I will.
You'll be hearing from us.
Looking forward to it.
This whole box is from
the residential school
that Sister Mary Grace taught at.
What is it?
A letter written by an Indian agent
on behalf of a mother who hadn't
heard from her child in two years.
Hey, I can go through
this and organize it
if you wanna check out for the day.
None of this is new to me.
But it doesn't get any easier.
You know, the first time I went
to school outside of Eskasoni
was in the seventh grade,
they bussed a handful of
us in from the reserves.
Anyway, I started talking about
residential schools in class
and the teacher overheard me
and he cut me off and he said,
"I know everything there is
to know about Canadian history
and I've never heard that!"
That grown adult man even scowled at me.
There was one other
native boy in the class
and he got my attention and whispered,
"my family too."
The rest of the kids just stared at me.
I knew right then that
something wasn't right.
You never told me that.
It must've been tough.
My point is that,
this was being hidden for so long.
Intentionally.
But we lived it.
Do you see this?
Looks like a diary.
It was written by someone
named Sister Theodore.
Yeah, listen.
"Dear Lord: I pray, I pray, I pray.
I pray for the soul
with a sinister role.
For within the purest of doves,
lies the power to
ignite the fire of hell."
Oh, gave me goosebumps.
- Huh.
- What?
She recorded her concerns
about how the children
were being treated.
By Sister Mary Grace.
What exactly are you looking for?
I understand you did the autopsy
on a drowning victim last week.
Basil Allen.
I'd like a copy of the report.
I can only release the
autopsy to next of kin
without the superintendent's approval.
Your mom knows that.
She said you might be willing
to let me just take a look.
Mmm.
You kids never wanna
do it the right way.
Well actually I do
represent the victim's
next-of-kin in Canada.
His fiancée, Trudy Willis.
Well, it says here his next-of-kin
is his mother Jean Allen.
In Jamaica.
Tell me this.
Are you comfortable declaring
Basil Allen's death an accident
precluding any further investigation
into the cause of death?
What are you talking about?
I made a full report to the RCMP,
stating that the victim died
from a blow to the head.
I don't decide who they
charge or don't charge.
I'm going for a coffee.
Fill your boots.
I'll be back in five minutes.
Tell your mother she owes me one.

Did Sharon let you in?
You scared me.
Iris Beals, Father?
Jarrod.
How can I help you?
I'm looking for a nun
named Sister Theodore.
Do you know where I can find her?
Sister Theodore sadly
passed away last year.
What's this in regards to?
I'm working a case regarding
a former day school.
I'm familiar with the case.
Uh, unfortunately, I can't help you.
Well, there must still be some records
pertaining to
Sister Mary Grace's time here.
I am sorry, no.
She was stationed here,
but she retired to the
motherhouse in Quebec
fifteen years ago.
This is a staff photo from when
the school was still operating?
Yes, it's from the early 80s.
Um, this is Sister Theodore
and Sister Mary Grace
and some of the other
day school faculty.
Would it be possible
for me to get a copy?
No, I'm-I'm sorry.
We can't have anything
to do with this case.
This mission was not
responsible for the day school
and now we're getting all the blame.
But ignoring the church's
role in the abuses that happened
doesn't erase history.
If you really wanted to
reconcile with this community,
you'd help.
Father, we found Sister Theodore's diary
and she was very upset with
what happened back then.
If she was still alive,
I'm sure she'd wanna help.
All I want is to find someone, anyone,
who knew her,
who could maybe
corroborate what she wrote.
So that her voice can still be heard.
I appreciate the heads up,
but just go ahead and cooperate.
I'll be fine.
Don't worry.
Thanks, take care.
That investigator from
the barristers' society,
looks like they're calling
everyone looking for dirt.
Yeah, I got the call too.
Just finding myself
too busy to call back.
Hmm.
Are you worried?
No.
Yes.
But I will deal with it later.
We have to work on our argument
to get this into evidence.
Sister Theodore's diary.
Aka Sister Mary Grace's
official record of employment
issued at the Pine River Day
school by her supervisor,
Sister Theodore.
Let's get to work.
Thanks for seeing me.
I wanted to talk to you
about the Ronnie Maloney case
that you argued last year.
Right. The child abduction case.
Is this about the appeal?
Opposing counsel was Doug Paul.
Martin, if you're concerned
about me being in conflict.
Marcie Diggs she didn't approach me
It's not about you being in conflict.
What was Martin Jesper doing here?
Did he offer you your old job back?
He's adding grounds to
the Ronnie Maloney appeal,
says that Colleen should
have recused herself
or that I should've asked
her to recuse herself.
That appeal's been going on for months
and now they're just
noticing who the judge was?
Ronnie Maloney does not deserve this.
I'm just the messenger.
I'll make some calls,
see what I can find out.
Ms. Beals?
I'm Eddie McDonaugh,
we spoke on the phone earlier.
Yes, hi!
Thank you for agreeing to meet.
Please.
I was surprised to get your call.
I found your name in a diary
written by a Sister Theodore?
Well
Thank God you found me.
What?
The things that I saw at that school.
It's been eating me alive for years.
That's ridiculous!
On what grounds could they
possibly wanna overturn
my verdict on the Maloney case?
They're saying since
you're boss at legal aid
that you shouldn't have heard the case.
I was harder on you than
anybody else in that courtroom!
It doesn't matter.
It's perception, right?
If Ronnie Maloney has to
go through a new trial
because of me I
Let's hope that the appeals
court refuses to hear it.
Hey, listen, I gotta go.
Good to see you, Colleen.
You're coming to our wedding, right?
Yes, sorry. I forgot to RSVP.
Of course I'm coming!
You're my best friend,
who I automatically
let win in my courtroom, right?
See ya.
We've uncovered a journal
kept by a former principal
at Pine River and we would
like it admitted as evidence.
On what grounds?
Sister Theodore was
Sister Mary Grace's supervisor.
We are submitting ledgers
and employment records
that correlate with the
entries written in the journal.
The dates also coincide with the abuses
that Sister Theodore recorded
and said that Sister Mary Grace
was the perpetrator.
Your Honour, we've
reviewed this document.
It is a diary.
It's a private diary written
by a nun who is now deceased.
It's impossible to test its voracity.
It was a working journal
that logged all of the
official performance details
from teachers and students.
Now if I may,
I'd like to just read a
small section to the court.
On October 22nd, 1982,
Sister Theodore wrote:
"I resuscitated a small child
from the primary class today
who's named Donald Christmas
after he was attacked by an
older student named Jason Bear.
Upon questioning, Jason said
that he was instructed
by Sister Mary Grace
to punish Donald because
he had soiled himself."
End quote.
Objection, Your Honour.
That's hearsay.
It's a business record.
None of that makes any
of these entries true.
Your Honour, the descriptive content
goes far beyond employment records.
Without the author here to testify,
I can't properly defend my client
against these lurid accusations.
I'm sorry, Ms. Diggs,
but Mr. Dubois is correct.
The diary is inadmissible.
Court's adjourned.
We will reconvene at 1:30.
Okay, you sure?
Yes, but is there anyone else,
any other contact person?
I understand.
No, thank you.
I treated students
under the authority of Indian Affairs.
Administered fluoride treatments,
conducted general check ups,
that sort of thing.
Can you speak to the general
health of the students
that you observed during your visits?
Yes, uh, I frequently
encountered children
who had visible bruises,
lesions, cracked teeth.
Did they ever explain how
they acquired their injuries?
I started stopping some
of them in the hallways
and outside just to chat, you know,
when Sister Mary Grace wasn't around.
That's when some of them
were brave enough to tell me
that Sister Mary Grace
goaded them into fighting.
Objection. Hearsay.
Sustained.
Dr. McDonaugh,
can you identify this child?
I
That's you.
Thank you, Your Honour.
I have no further
questions for the witness.
Dr. McDonaugh.
How may years did you treat children
at the Pine River Day school?
Uh, for 43 years.
And yet during all those years,
despite your alleged
concern for these children,
you never spoke to anyone about it?
I reported my observations to
my supervisor at the time
But you never made an
official complaint.
No.
I see.
Dr. McDonaugh,
if the children under your medical care
were really suffering,
why didn't you try to help them?
Why didn't you do anything?
Why aren't you sitting right there
next to my client facing charges?
You're right.
I should've done something. I
I am responsible.
I'm so sorry.
I should've tried harder.
Hey.
Relax, it's not like I'm
gonna throw you overboard.
How can you even joke about that?
Aw shit.
Sorry.
You're right.
But hey, you said some
pretty crazy stuff,
like accusing my brother
of getting people killed.
Yeah, your brother's a
liar and I have proof.
What kind of proof?
I saw the pathology report.
Contradicts everything Brian
said about what happened
to your worker on that boat.
Not my worker.
I don't work for the family business.

This is ridiculous. Stop this.
Just hold on, be calm.
Sister Mary Grace.
Donald deserved every
beating he ever got.
He never listened and clearly
he never learned his lesson!
Sister, you need to calm down.
Calm down?
He is speaking that primitive language
that none of us can even understand
just to make up lies about me!
Enough!
Court is adjourned.
Probably the best thing we can do, so
My client has been diagnosed
with pancreatic cancer
and has very limited time left.
Wow, how convenient.
Yes, it's because I work for God
and God takes care of me.
We can provide the medical records
attesting to the recent diagnosis.
Is that what you want?
To send a dying woman to prison?
Yeah.
We'd like to offer a plea deal.
An apology.
I will never apologize!
My actions were
sanctioned by the church.
I would never accept an apology from you
because it would mean nothing.
You know, the word sorry
doesn't have a meaning in my culture.
The only way to fix a problem
is by changed behaviour.
This is insulting.
She couldn't control
herself in the courtroom
or in this very moment.
Could you imagine what
she did to her students?
An apology is unacceptable.
I answer to God.
I do not answer to you.
Please, stop.
This deal's gonna work on our terms:
Sister Mary Grace will
make a KGB statement
providing the names of
her co-conspirators
so that when she dies the evidence
will still be admissible in court.
Now, she can either take the
deal or she can die in prison.
What's this?
Affidavits signed by Sister Mary Grace
listing the names of
all the other abusers
at Pine River Indian Day,
as well as residential school.
This is incredible.
There is a litany of
abuses and assaults here.
Described in graphic detail.
I have to hand it to you, Doug.
Good job.
Now do yours.
What do you have?
Basil Allen's pathology report.
Zero alcohol levels and signs of trauma
indicating signs of a struggle.
No water in his lungs
so he didn't drown.
He died on that boat and
was thrown overboard.
So, we have the Clawfords?
No, we have their fall guy.
Michael McLeod, 43, of
St. John's, Newfoundland,
with a history of summary offences
around drinking and fighting.
He turned himself in.
Admitted to assaulting Basil
and knocking him overboard.
These people
They kill Basil Allen's
little brother and then they,
they had their lackey kill him?
I'm not letting them get away with this.
- Marcie?
- Yes?
Thank you.
It's from Vivian Jefferson's lawyers.
She's giving me thirty days
to pay back the eight million
that she invested or
She's selling off her
interest in the firm.
What?
I, I need a minute.

What's up?
I need to see you.
