Hawaii Five-O (1968) s08e19 Episode Script

Anatomy of a Bribe

7- Victor- 1, Code 2.
The fire has been raging most of the night.
Three companies under the direction of Fire Chief Sam Shigata have been battling the flames, the origin of which is still unknown.
But to those of you who have just tuned in, this is Bill Heinz reporting to you on Channel 9.
We're at the scene of a fire which broke out sometime last night in the new Global Trade Center.
The Global Trade Center, completed less than a month ago and expected to serve as a nerve center for expanding trade in the southern hemisphere, is now a flaming inferno.
At present, there are two known dead and an unknown number Hey, do you know what time it is? You're gonna be late to the office.
- the fire is now partially contained - Look.
And surrounding buildings are not in immediate danger, but the trade center is expected to be - a total loss.
- Oh, no.
That's your building.
The fire was first discovered on the third floor - Been burning most of the night.
- How did it start? who promptly turned in an alarm.
Although the first fire company - I don't know.
- arrived in a matter of ten minutes, the flames had already spread to fourth and fifth levels of the structure, and smoke and flames had enveloped the building.
Fire Chief Shigata stated that never in his experience - Yeah? - Hi, it's me.
Have you heard? Are you? Are you kidding? There's nothing else on TV.
What are we gonna do? Just listen.
But don't write anything down.
Pack some things then drive north on 83 to Kahuku.
There's a house a half a mile off the main road on the right.
You'll find a key under the mat.
Wait there for me.
- When are you gonna get there? - As soon as I can.
But don't tell anyone where you're going.
Not your wife, not your best friend, no one.
You got that? - As you can see from watching - Yeah, I got that.
Marty, we're in this together and I'm the only one who can help you.
I'm your only chance.
Remember that.
Police personnel on the scene requested unauthorized individuals to remain away from the fire scene.
The streets for several blocks around the site have been cordoned off and anyone seeking to reach buildings in the vicinity of the Global Trade Center are advised to wait until authorities have pronounced the area clear.
- Easy.
Where are you going? - Little trip.
Nothing to worry about.
Marty, you're in some kind of trouble.
- The fire? - No, no.
Nothing like that.
I know you're in trouble.
I can always tell.
What is it? I can't talk right now.
I'll call you later, huh? Marty? Where are you going? Right now, it's better if you don't know.
Why? Because what you don't know, you can't tell anybody.
I just heard the news, sir.
Steve, I believe you know Fire Commissioner Lawson.
Ralph, how are you? And Commissioner Barnes, Building and Safety.
Commissioner.
The fire is finally under control, Steve.
We're just lucky it happened before most people came to work.
What's the final casualty count, sir? Three dead.
Twelve injured, two just hanging on.
Four of those injured were firemen.
A global trade center.
A link between the Orient and the Western world.
A link of commerce, of friendship.
All races, all nations.
Now that dream has turned to ashes.
And not by accident, Steve.
Are you suggesting arson? Not exactly.
Ralph? Well, the fire started from an electrical overload, but it spread so fast, the fire marshal got suspicious and he started an investigation right away, even before the fire had gone out.
Now, here's what he's found so far.
Wires too thin to carry the electric load.
Cheap wallboard.
Those fragments are part of a wall that should have been fire-retardant steel.
We suspect the whole building is substandard, at least half a dozen ways.
In effect, we're dealing with murder, Steve.
Murder by fraud and criminal negligence.
Who was the building contractor? Rogers.
Martin Rogers.
We've been trying to reach him all morning, but no luck so far.
Oh, a contractor couldn't pull this off alone, governor.
It calls for a building inspector who approves the work with something green passing between them.
Who was the building inspector on this job? Could have been anyone of a half a dozen men.
My assistant's checking it out now.
Let's get down to your office and find out what he's learned.
Governor, we'll keep in touch, sir.
Excuse me.
Excuse me.
Could you come into my office, Vince? And bring the trade center file.
Vince Maynard, my top inspector.
Steve McGarrett, Hawaii Five-0.
Mr.
Maynard.
Five-0? Am I to assume we're under investigation? Would that disturb you? I've never been one to enjoy Big Brother looking over my shoulder.
But as to being disturbed, the answer is negative.
We're always looking for flaws in our system.
With or without outside help.
Maybe we can help you find some of those flaws.
- Right now, we're looking for - You're looking for one individual.
The inspector who made the final approval on the Global Trade Center.
The final inspection was made by Joe Kimura.
Kimura? Are you sure? There it is in black and white.
That's his signature.
The last one I would have suspected.
A 25-year man in the bureau, due to retire soon.
I know how you feel about the old-timers, commissioner, but, you know, if they'd been running such a tight ship, you wouldn't have had to call me in from the mainland.
Where's Kimura now? He's in the field.
Can't tell you exactly where.
Let's bring him in for questioning, huh? Yes, sir.
I'll see if I can find him.
Oh, Mr.
Maynard, just a minute.
I'll have one of my men go along with you.
Assistance or supervision, Mr.
McGarrett? Let's find Joe Kimura first and we'll discuss definitions later, huh? Use your phone? Operator, get me the Five-0 office, please? - Steve.
- Yeah, Danno.
I checked with Rogers' office.
He hasn't come in this morning and no one knows when he will be in.
- What about his home? - Negative.
I called his wife.
She doesn't know where he is either, but here's the address.
- Get a description? - Yeah.
Get out an APB, special attention, docks and airports.
Let's hope he hasn't skipped the island already.
Right.
Kimura was here.
He left about a half hour ago.
That narrows it down to about six sites.
We'd better get started.
Look, why don't we split them up, three and three? Save a lot of time.
Okay.
Makes sense.
Here you go.
- Mrs.
Rogers? - Yes? McGarrett, Hawaii Five-0.
May I speak to you a moment, please? I don't know what there is to talk about.
Your assistant already called me today.
I told him Marty left yesterday and I don't know where he is.
Well, you don't seem worried.
Why should I be worried? He's gone on trips before.
Without telling you where? I don't keep tabs on him, Mr.
McGarrett.
That's what Pat did, his first wife.
I don't wanna be another ex-wife.
Do you know why we're looking for him? - The fire? - Yes.
I'm sorry for those people who were injured and killed in the fire.
And I know Marty is too.
Then you've lied to me.
What do you mean? You just told me that your husband left yesterday.
If you've discussed the fire with him, that means you've either seen him this morning or talked to him on the telephone.
Which is it? I don't have to discuss this with you.
I'm not a criminal.
Somebody is, Mrs.
Rogers.
Somebody is responsible for those injuries and deaths.
Now, I've seen the evidence.
Cheap, penny-saving, substandard materials that went up like a tinderbox.
Whoever put those things into that building might just as well have held a gun to his victims' heads.
Not Marty.
Marty wouldn't do that sort of thing.
He's a decent, honest man, so you leave him alone.
Do you hear me? Just leave him alone.
Central? McGarrett.
Give me a patch to Five-0, please.
- Lukela.
- Duke? Steve.
I want a round-the-clock surveillance on Mrs.
Betty Rogers, just in case her husband makes contact.
Take care of it myself.
Oh, any word on the building inspector, Joe Kimura? Not yet.
Still waiting to hear from Chin and Maynard.
Okay, Duke.
Kimura.
Mr.
Maynard, what are you doing here? - You don't know? - No, sir.
I hear the reinforcing doesn't conform to the plans.
Wrong tensile strengths, all undersized rods.
Not so.
They're number 5s.
I hear they used number 3s instead of number 5s.
- I checked them myself.
- Let's go.
We'll check them again.
I hope this won't take too long.
I was going home to work on my boat.
This is more important.
Okay.
Oh, thank you very much.
- Who is he? - Name's Kimura.
A building inspector.
He either jumped or fell off from the top.
- Any witnesses? - Yeah, those kids over there.
They were driving past in a car.
- Who saw the fall? - I did.
Could you tell what caused it? No.
He was already in the air when I saw him.
It was terrible.
Did you notice anyone else up there with him? No.
You mean no one else was there or you didn't notice? I didn't think to look.
Okay.
Okay, that's all for now.
Thank you.
Strong odor of alcohol, Steve.
Look around for a bottle, Danno.
That stuff doesn't come in paper bags.
Joe Kimura.
You were supposed to bring him to the office.
I was looking for him.
I'm not a Five-0 expert.
A Five-0 man was assigned to go with you.
Where is he? We split up because, otherwise, we'd have never finished.
There were too many places to cover.
Danno, I want a complete autopsy report.
Blood sample, condition of vital organs, the works, as soon as possible.
Those whiskey fumes could knock you out.
Was Kimura a heavy drinker? I don't know, but the trade center fire and three people dead because of him, how much can a man have on his conscience before he cracks? If you don't mind, I'll skip over the obvious traumas caused by a high fall and get to the heart of the matter.
Yeah, please do, doc, huh? Blood chemistry, Kimura, Joseph.
Alcohol content, 0.
03 milligrams per 100 cc's of blood.
Now, if a man drinks one ounce of whiskey, he will have 50 milligrams of alcohol in a sample of blood that size.
If he's a heavy drinker, he'll have 100 milligrams or more.
But 0.
03 percent, that's negligible.
Could be what's left of a cocktail he had the night before.
Just a minute.
Are you saying that Joe Kimura was not drinking when he fell? Not for many hours, at least.
Then all that alcohol on the corpse could have been a plant to deceive us, to cover a homicide.
Well, I should have known better.
Drinkers don't pour booze on their clothes, they pour it in their mouths.
That ties in with what I found at the building site.
Neck of a whiskey bottle.
The cap's still sealed.
Nobody opens a bottle like this if they plan to drink out of it.
So I would assume then that somebody wanted to make it appear that Kimura was drinking heavily because of some guilt feelings.
Or maybe he wasn't guilty at all.
But he was guilty, Steve.
He signed the inspection report on the trade center.
So far, all we know is that this inspection report was signed with Joe Kimura's name.
Now, get this over to Che Fong in the lab.
Tell him I want it checked against every conceivable test for forgery.
Come in.
Where you been? What took you so long? There's been a lot going on, Marty.
Things I had to handle.
How come I'm the one who has to run and hide? Because you're the one they're looking for.
- You put up the building.
- You made the final inspection.
Wrong, Marty.
Final approval was given by Inspector Joe Kimura.
Kimura? - I never heard of him.
- Well, that's what the record shows.
And I don't know whether you heard, but Kimura got drunk and jumped off the new Alema building.
Kimura never came near the trade center and you know that.
Marty, listen to me.
All you've got to do is lie low here until the heat's off.
They'll never bring charges because the man they think you conspired with is dead.
- This place belong to you? - Yeah.
All right.
I'll stay here for the time being, but let's get one thing straight, Maynard.
I am not taking the rap for this alone.
If I go under, you go too.
Marty, nobody's going under.
This is the inspection report with Kimura's signature on it.
The signature is authentic as evidenced by these comparisons.
Inspection report, driver's license, Social Security card.
Authentic, no question about it.
But look at this.
Notice the faint rectangular field around the signature.
Hardly visible, except by photo enlargement.
The field is actually a different color.
You've seen it.
It's what happens when something is pasted on a sheet of paper and then photocopied.
Lights, please.
But if the inspection report was doctored, you'd see it on the original.
You would spot the paste-up job.
Exactly.
So we tried to get the original, but none of your staff could find it.
Only photocopies in the dossier, only photocopies everywhere.
I'm shocked.
What else can I tell you, Steve? Who framed Joe Kimura? Who had access and opportunity to pull off something like that? Only one man I can think of, Steve.
The man I brought here from the mainland to update the department.
Maynard? Exactly what was Maynard's background? Advisor to building syndicates.
High-level construction work for the government.
And he did a column for an L.
A.
Paper on buildings and real estate.
- Top man in the field.
- Top shakedown artist.
I'd hate to think so.
Commissioner, would you help me put him to a test? Of course.
Get me Dave Harris of Harris Construction, please, on Kalakaua? Yeah? Put him on.
- Aloha, Steve.
- Dave, I have a favor to ask.
You just name it, Steve.
I wanna put up a building.
A defective one.
They're actually plans we considered a year ago and then abandoned.
I just had to change the date and add a few code violations.
Perfect, Dave.
Perfect.
Have them delivered to the Building and Safety Bureau first thing in the morning.
I have Commissioner Barnes alerted.
You really think Maynard will hit me for a bribe so soon after the fire? He will if he thinks he's in the clear.
Bet on it.
Just in from Harris Builders.
Plans for a beachfront condominium.
Look them over, will you? Glad to, commissioner.
By the way, Five-0 just called.
They're convinced that Kimura conspired with the contractor of the trade center.
Rest of the bureau, clean bill of health.
I could have told them that.
- Special delivery, ma'am.
- Thank you.
- Yeah? - Marty? Marty, it's me.
- Where you calling from? - From a phone booth, just like you said in the letter.
Honey, where are you? Beach house, north side of the island.
Honey, I need your help.
Of course.
Just tell me what you want.
Okay.
Go to Koko Marina, look for a guy named Sinto, Captain Pete Sinto.
Tell him you wanna charter his boat for a fishing party to Upolu on the Big Island.
Tell him he's gotta keep it real private and it's worth 1000 bucks in advance.
- Don't give him your name, huh? - Captain Pete Sinto, Koko Marina.
Don't write it down.
And memorize this phone number and then burn the letter I sent you, huh? Yes, Marty.
Marty? I love you.
Yeah.
I love you, honey.
Duke see the number that Mrs.
Rogers dialed? No, it was too far away.
Couldn't get any closer without blowing his cover.
But he did notice one thing, Steve.
She dialed only seven digits.
That means no area code.
So if it was her husband, he's still on the island.
Oh, it had to be Rogers.
He figures we got a tap on his phone.
Chin, get some H.
P.
D.
Backup for Duke.
He must be punchy by now.
But I still want a 24-hour surveillance on Betty Rogers.
- McGarrett.
- Steve? Dave Harris.
I think our fish took the bait.
- He took the bait? So soon? - Just now.
He suggested we have lunch today.
I'm to meet him in the Lanai Room at 1:00.
That gives us two hours.
Where are you now? Well, in my office.
Okay, stay there.
We'll be right over.
Danno, go up to Technical Operations, requisition a CER-237.
- I'll meet you in the car.
- Right.
There it is, the CER.
Looks like an ordinary attaché case, doesn't it? Even when you open it, there's nothing suspicious inside.
On-off switch, microphone.
Now, make sure it's not blocked when you're recording.
And keep it as close to you and Maynard as possible without raising his suspicion.
There it is.
Concealed electronic recorder.
Beautiful.
When do I get my Five-0 badge? Be careful, Dave.
You might be dealing with a murderer.
- Mr.
Maynard.
- How do you do? - How do you do? - I hope I haven't kept you waiting.
No, no, I just got here.
Please, sit down.
- Gentlemen, something from the bar? - Yeah, I'll have a double Rob Roy.
Tomato juice.
Well Well, I guess we had to meet sooner or later.
I've always admired those buildings of yours.
The Oahu Towers, the Koloa Department Store.
Beautiful.
Well, I give my architects the credit.
Someone had to hire the architects.
Thank you.
Here.
Now let me show you some beautiful work.
Skytop, our new concept in apartment living.
We call it, "Seeing the future through the eyes of Hawaii's past.
" Skytop, yes.
I went over the plans very carefully.
- Problems? - Oh, come on, Mr.
Harris.
You don't really think you were gonna get away with that, did you? Excuse me.
Double Rob Roy on the rocks.
Tomato juice, sir.
Thank you.
Its costs.
They're killing us.
If we stuck to each letter of the code, we'd be out of business.
Other builders manage.
Other builders get waivers sometimes.
Don't they? Yes.
Under certain conditions.
What conditions? Travel much in the islands, Mr.
Harris? Sometimes.
There's a beautiful town on Maui, a place called Kahului.
On the bay, north coast.
- Oh, you've been there.
- Once.
I wonder what the population is? Nine, 10,000.
Too low.
I'd say 50,000.
Would you agree, Mr.
Harris? - Seems high.
- Not at all.
I'd say 50,000 is exactly the right figure for that town.
Well, would you agree, Mr.
Harris? Well, I wouldn't argue with a man who knows the islands that well.
- When can I? - Tomorrow, lunch hour.
Fun Lanes Bowling Alley.
Make sure you bring everything you need, in a bowling bag.
Assuming that all conditions are met, how long does it generally take for the waiver to go through? I just remembered, I have a call to make.
Would you excuse me? Certainly.
- Yes, sir.
- There's a call for Mr.
Harris.
Would you get him, please? He's on the terrace.
- Of course, sir.
- Thank you.
- Mr.
Harris? - Yeah? You have a call in the other room.
Would you like to follow me, please? Sure.
I'd say 50,000 is exactly the right figure for that town.
That's money talk.
No question about it.
- Did you agree to his figure? - Naturally.
When is the drop? Tomorrow, 12 noon at the Fun Lanes Bowling Alley.
I'm to bring the 50,000 in a bowling bag.
Danno.
I want that bowling alley staked out, plain clothes men at every door.
Money marked in the usual way.
As soon as the money changes hands, we move in.
McGarrett.
What? He's here to see me? All right, I'll be right out.
Don't you ever knock? This is urgent, Mr.
McGarrett.
I wanna report an attempted bribery.
A builder named Harris offered me money to approve faulty specifications.
I want him arrested immediately.
Or was it a case of entrapment? There was no entrapment, Mr.
Maynard.
But there was an attempt at shakedown.
You should know about that, huh? And now I'm going to sue you personally for slander and defamation, as well as the state for entrapment.
How does a cool million grab you? Well, there are the facts, John.
He threatens to sue me personally and the state for $1 million.
Bluff or possibility? Anyone can sue, Steve, but winning is something else.
- Determined how? - Whether the entrapment took place.
And he has to prove that your statement defamed him.
As I understand it, it is perfectly legal for us to provide the opportunity for a suspect to commit a crime, just so long as we do not entice him into doing it, - is that right? - That is correct.
Well, then I can assure you, John, that no entrapment took place here, nor would it ever be condoned by this office.
- Is that verified by the tapes? - Not quite.
Unfortunately, not every word is audible.
And he was very clever in his use of language.
Who was the first to mention a bribe? No bribe was actually mentioned.
Harris, our cooperating contractor, asks for a waiver.
How does Maynard respond? He responds by discussing the population of Kahului.
A cover for money talk, John.
It's as plain as can be.
But he never actually mentioned money? Oh, don't be naive, John.
Anybody would know exactly what he meant.
That's not good enough, Steve.
As district attorney, I tell you that evidence would never stand up in court.
He may not win the lawsuit, but he could hold us up in litigation for months.
Not to mention the embarrassment he would cause.
We're an investigative agency, John.
I'm not worried about embarrassment.
- McGarrett.
- Steve.
George Barnes.
Maynard just resigned.
He resigned? Did he give a reason? He accused me of working with you to set him up for a frame.
- And that's it? - There's more to come.
After he left the office, I had a call from the airlines, confirming Maynard's reservations for the mainland tomorrow.
Now, that's a mighty fast departure.
Yes.
Thank you, commissioner.
We'll call you if anything breaks on this end.
Maynard just resigned.
He's booked on a flight to the mainland tomorrow.
After all that yelling about a lawsuit? Makes no sense.
Yeah, it makes no sense if we take the lawsuit seriously.
But what if all that talk was just a smokescreen? A rearguard action to put us off guard while Maynard was making plans to beat it? And leave Rogers on the island? Let's put ourselves into Maynard's head.
Now, he knows that Rogers can put him away for bribery and for murder maybe.
Which means that he could be extradited from practically any country in the world.
And Maynard's not the type to leave loose ends behind.
Exactly.
Exactly.
And that's what I'm worried about, gentlemen.
I think that Maynard will kill Rogers before he leaves for the mainland, and there is only one way to stop him.
She's over there, Steve.
Okay, we'll take it.
- What do you want? - To find your husband right away.
I don't know where he is.
Well, we think you do, or at least a phone number.
Hey, look, the lady said she didn't know, so I think that's the end of it, mister.
How would you like to navigate into the lockup? Now on your way, mister.
We think your husband's life is in danger.
That somebody is trying to kill him.
It's a trick.
You wanna find him so you can arrest him.
It's not a trick, Mrs.
Rogers.
There are criminal charges against your husband.
But criminal charges means a trial, with legal defense, built-in protections, and a chance to go free if he's innocent.
And survival.
- But if Maynard gets to him first - Maynard? Yeah, Maynard.
We think he killed Joe Kimura, the building inspector.
And we think your husband is next.
Now which will it be, Mrs.
Rogers? A chance for him in court or what Maynard has in mind for him? He's staying at a beach house, north coast to the island.
He mentioned Kahuku Point.
What's the phone number there? Thank you.
Let's go.
McGarrett to all available cars, Kaneohe to Kahuku Point.
Be on the lookout for Vincent Maynard, believed driving north to Kahuku.
May be driving a Building and Safety Department vehicle.
Intercept and notify.
Central? Contact the Hawaiian Telephone Company computer room, get me an exact location of telephone number 732-5577, please.
- Yeah? - Marty.
Marty, it's me.
- You've gotta get out of there.
- What's the matter? Maynard.
Maynard's on his way.
The police just told me.
Oh, God, get out of there, Marty.
All right.
Now listen, don't worry.
Hold it right there, Marty.
Drop it.
This gun is loaded.
Drop it.
Don't feel too bad, Marty.
I've made mistakes myself.
I'm gonna show you one right now.
Your car.
Get in.
Duke, check that car.
Chin, take the back.
Let's go, Danno.
Go.
- Nothing.
- Nothing in there, Steve.
Danno, get on the horn to Central.
Tell them I want roadblocks set up on State Highway 83.
Tell them who we're looking for, give descriptions - of Maynard and Rogers.
- Right.
And I want H.
P.
D.
Chopper surveillance too.
There could have been gardens, music, the sound of people laughing.
It was a simple ambition, really.
To build the greatest hotel in the world.
Come see my hotel, Marty.
We picked the location, paid a premium price.
I stayed on the mainland to raise the money.
My partner came here to build.
Over there, Marty.
Over there.
Central to McGarrett.
Central to McGarrett.
Yeah, McGarrett.
Go ahead.
Two suspects fitting description spotted by H.
P.
D.
Chopper at the old Lagoon Hotel complex on Lagoon Drive.
They have left their vehicle.
Advise.
All available cars proceed to that location, immediately.
Stand by for instructions.
Silent approach.
I repeat, silent approach.
Let's go.
I wasn't here when they started construction, but I've seen it in my mind a thousand times.
They brought in equipment to hammer the foundation posts into the ground.
And the posts began sinking.
Sinking.
Until one by one, they disappeared forever.
This lovely site turned out to be a sheet of lava, directly over a crater.
Come on.
Go ahead.
The inspectors came.
They told my partner our site was unsafe for building.
We proved to them it could be done.
New engineering techniques, slashing innovations.
Untried but perfectly valid.
But the state of Hawaii said no.
And that was the end of our fortune.
My partner killed himself.
But I had other plans for the glorious state of Hawaii.
McGarrett, H.
P.
D.
Cars More units approaching from Mauka.
This is McGarrett.
All units take position and stand by for instructions.
Get down here for a minute, Marty, I wanna show you something.
Listen for the sound of the impact.
You hear it? - No.
- That's quite correct.
There was no sound, no impact, no bottom.
Some people believe these channels lead to the fiery core of the Earth itself.
Who knows? Maybe we've discovered hell.
- Walk over there.
- Vince, no.
Move! Vince, no.
This not exactly a request.
Look, I'm not gonna talk.
I'd be hanging myself.
I'd Hold it right there, Maynard.
You're covered and completely surrounded.
Throw down your weapon.
I said, throw down your weapon.
Now put your hands on your head and walk toward me.
Watch it.
Watch it.
Open fire.
Open fire.
Hold your fire.
What are you all doing here? Keep out.
You don't belong here.
We're not open to the public yet.
Bellhops, you get back to your stations.
Get back to your stations.
There'll be hundreds of cars arriving from the airport.
There'll be luggage.
You'll have to take them to the rooms.
Get back to your stations! Wing him.
Rogers, come out with your hands up.
Danno? Get an ambulance, he's bleeding.
Chin, watch him.
Book him, Danno.
Conspiracy, fraud, bribery and manslaughter.
- McGarrett? - Yeah? Safety deposit box, Ala Moana Bank.
Hundred grand I saved on construction costs.
I'll give you a full confession.
Anything you want.
I can make no promises, no deal.
You got here.
That's good enough.
The last few days been a living hell.
I guess that's better than the real kind, isn't it?
