Somewhere Between (2017) s01e07 Episode Script

The Fourth Man

1 Previously on "Somewhere Between" I thought they got a warning.
Apparently, it wasn't loud enough.
Nico: Why did one of those sunburned frat boys shoot Haskell DeBray blackmail the D.
A Serena, where did you put your time capsule, baby? drown a little girl? Could those three things have less to do with each other? - Five! - Five what? - Five! - She wasn't stabbed five times! - Five! - She was stabbed 13 times! Tom: My wife isn't well.
She's taken Serena.
She's denying contact.
With Nico Jackson? Danny: You got drunk.
You loved Susanna and you would never hurt her on purpose.
It was you.
I saw you kill her.
I didn't want you to go to jail.
[Phone rings.]
Mr.
Price? Tell me you found them.
They locked a couple of tourists into a bunker in Spanish Harbor.
That is not something Laura would do.
Nico did the locking, but your wife and your daughter were with him.
There's more.
Nico visited his brother in prison 30 minutes ago.
We've got a fifty-mile radius covered.
We're closing in.
- He saw it.
- I don't believe it.
That's what he said.
He said he saw me do it.
That's insane.
You couldn't kill the woman that you loved since you were 7-years-old and forget about it.
You know I black out.
You know what I'm capable of with the right blood alcohol level.
You saw what I got fired for.
You were drunk when you beat up the meth guy? I left that part out, didn't I? Made myself out to be the vigilante hero.
But you had a motive.
Real anger.
What motive do you have with Susanna? You were gonna propose to her.
You told me the whole story.
That's exactly what it was.
It was just It was a story.
You want to know what really happened? Whoever was with Susanna the night she died is the same person who was with Serena the day she died.
And that person wasn't you.
So let's figure this out together.
Tell me.
I was working.
I was taking care of Danny while my mom looked after Ruby.
And Man, I was I was so stressed out, you know? I was drinking and I was screwing up.
And all I wanted to do was show Susanna that I could do right by her.
That I could I could change.
So what does genius Jackson do? He stops off and has a couple drinks before he heads to her house.
[Soft music playing.]
[Chatter in house.]
Susanna: They're beautiful, Danny.
Danny: I know you like yellow things.
I love yellow things.
Yeah.
If I was yellow, would you love me? I already love you.
[Laughs.]
Oh.
Oh, oh.
Oh, okay.
[Door slams.]
It's all good.
You're good.
- You're so out of here.
- What? Whoa! It's Susanna's house, and only she can get me out of it! - Get out of here! - Nico! It's not a problem.
How is my brother humping my girlfriend not a problem? He's not humping me.
He's harmless.
Harmless? Why don't you tell that to the crackhead that showed up at my mother's house and said, "Hey, here's your baby granddaughter.
Have a nice day, Mrs.
Jackson.
" He can't help it.
- No, but you can.
- What does that mean? "Oh, oh, Danny, you're so cute! You're so cute I could eat you with a fork.
" - [Whimpering.]
- "Come here, Danny! Come here and snurgle wurgle murgle with your bestest bestie!" - Oh, my God.
- I used to think it was mixed signals, but maybe not so mixed.
That is so far beyond uncalled for.
Yeah, it sucks, having to take care of your brother until one of you dies.
But so does being an ugly drunk.
I was going to propose to you tonight.
[Gasps.]
But you like him so much, I'll just take off, okay? You can give him what he wants! Propose? Are you blind to what's been going on with us? I used to wake up every day excited 'cause I knew there was you.
Do you know what I have to do now, when we're making love? Pretend I'm with somebody else.
With Nico Jackson, not this drunk, full of himself pig he's turned into! No! [Grunts.]
[Scoffs.]
We're done.
It's a small town.
Either you move away, or I will.
I-I'm sorry.
I-I'm sorry for everything, Nico.
She's all yours, brother.
I'm done with her.
Next move That's the predictable one.
[Rock music playing.]
[Indistinct conversations.]
Hey.
What? Let me buy you a shot.
I'm working.
It's Independence Day.
You gonna let the Redcoats tell you what to do? Okay.
One more.
I had plenty of time to get royally hammered, go back to her house, and pick up right where I left off before Danny grabbed my arm.
I had plenty of time to kill her.
Plenty of time to go and pass out in the woods.
And somewhere in there, Danny made the decision to take the rap for me.
[Gasping.]
She's dead.
- Oh, God.
- I killed her.
Me, the worst brother since Cain.
If you did it, why didn't Jason recognize you? Sure freaked out when I walked in, didn't he? Yes, because you were loud and big.
He kept saying "Five.
" "Five!" Maybe there was five guys instead of four.
Maybe I met up with the four dudes Jason and his buddies and we partied all night.
But it was me holding the knife.
Me.
Number five.
Five.
Five.
Five.
Okay, okay.
You're the killer.
Then why is the fourth man terrorizing us? Same reason somebody killed Jesse Reid when he went to the D.
A.
's office.
Anything to keep the secret.
You want to know the ugliest part about the ugly truth? When I saw Danny carrying that body, the first thing I thought was, "I did that.
" [Sighs.]
And then when he said it was him, I was relieved.
[Vehicle approaches.]
[Police radio chatter.]
Time to go, angel! Hey.
Take Serena and get out of here fast.
What? You can save her.
I know you can.
- I'm turning myself in.
- Hey.
What about the other two women Danny confessed to killing? You think you killed them, too? I black out.
What if you're wrong? Danny loses a brother, your mother loses a son? For right now, Danny is alive.
Fate has him scheduled to die in three months.
Serena drowns in two days.
I can't save Serena without you.
If you turn yourself in you might as well take her to Black Pine Cove and drown her yourself.
Come on.
Let's go, baby.
Where's Captain Nico? [Car engine starts.]
I'll wait until Serena's safe.
What's the next stop? [Laughs.]
The look on your face.
The police respond very quickly to calls from this house.
Don't be a fool, Tom.
You know exactly who sent us and why we're here.
There was a mixup over which safety deposit I put the jewelry in, and I'll have it as soon as I can.
That's right on who we are, but that's not the only reason we're here.
We came here to tell you get your wife under control.
We don't like in-person visits.
Don't make us come back to say that again.
How long after Susanna was killed did Danny confess to the other two killings? Two days.
Long enough for someone to get to him in jail and scare him into it.
Somebody who needed all three cases sewn up, and still does.
Maybe that's not what he meant when he said he was scared.
Maybe he meant he was scared I killed the other women, too.
That's one theory.
Here's another one.
Somebody else killed all three women.
If we find that person and they have a tattoo, we'll know who's coming after The cops were trying to solve the other two murders for months before Danny confessed.
They had to have had suspects, leads, a theory.
But getting the files could take weeks.
I have a way of getting every scrap of paper on all three killings.
It'll take no time, but, man, the fee is brutal.
Nico! Hey, Mom.
Oh! Ruby! - I am so happy you're here, Mrs.
Price.
- Thank you so much for having us.
Oh, thank you for the best - All right.
Okay, Mom.
- phone call - I ever got in my life.
- All right.
So you believe me now? You know Danny didn't do it? - Yes, I do.
- Oh.
- Serena: I have to show you something.
- Okay.
Then who did it? Who? We don't know.
We are, um, just following up on some leads.
Mrs.
Jackson, do you have the police files on Janice Kim and Carina Markovich? - Oh, I have everything! - Yeah? - Come on in.
- Thank you.
They had the FBI, the troopers, and the sheriffs all looking for who killed Janice and Carina.
And then out of the blue, Danny says, "It's me! Over here! I did it!" And it was "No further questions, ma'am.
" Look.
Here.
Look at his confession two days after the arrest.
[Sighs.]
"I crouched like a tiger, and when she came into her room, I pounced.
" Did you ever once hear him use a metaphor in your life? No.
He did not come up with that on his own.
And look at this! It's Danny's deposition in September, two months later.
"I crouched there like a tiger, and when she walked into the room, I" "I pounced.
" Look at them side by side.
Practically word for word, all the way down.
That's what I always said! He was coached! The real killer got to him in jail, right there in front of the cops.
Or he was a cop himself.
Mrs.
Jackson, can you show me everything you have on Janice and Carina from before they got Danny? Box 19D, right here.
I wish I could call my dad, but I promised my mom I wouldn't because he's in a trial, and he can't have any distractions.
Bet you a million bucks he wants to talk to you anyway.
You should call him.
I can't.
My phone doesn't work.
Mine does.
I can never call my dad.
I have to wait for him to call me collect.
[Phone beeping.]
[Ringing.]
[Phone beeps.]
- Hello? - Ruby: Daddy, I miss you so much! [Sighs.]
I miss you, too.
Where are you? I'm at Ruby's house.
We went to Spanish Harbor, and we slept in a bunker, and we visited Grandma.
That's wonderful.
Sweet pea, do you have your time capsule with you? [Sighs.]
Yes.
I'm sorry I broke my promise.
I wanted to give Vivica a drawing I put in it.
That's okay.
You know, I put something in there, too, to keep it a surprise.
It's a present for Mommy.
For our anniversary.
Your anniversary's not till October.
Our first-date anniversary.
And I need to come pick it up so I can wrap it up special.
Will you stay at Ruby's until I get there? Of course.
And can you keep it secret, so it stays a surprise? Cross your heart? Okay.
- I love you.
- Love you, too.
Bye.
Bye.
[Phone beeps.]
They liked Carina's ex-boyfriend for a second.
[Grunts.]
He was angry because she aborted their child, and there were scenes.
But he was in Chicago.
There was another.
They went after a registered sex offender in Sebastopol, after the first killing.
But they couldn't make anything stick.
This is Carina? What did you find? That's Janice.
Mom, was this jewelry in evidence? No.
That's nothing.
They're just things the families told the cops were missing after Janice and Carina were killed.
This is not nothing.
This is everything.
This proves absolutely 100% - that Danny didn't kill those other women.
- What? These things were found in Haskell DeBray's apartment.
Trophies he kept.
This is the proof that Haskell DeBray killed Carina and Janice.
We have to go to the police right now.
- Right now, just this second! - No, Mom.
Mom, Mom.
The jewelry's gone.
It was taken from lock-up.
There's nothing to test.
There's nothing to show.
Hey.
Do you think Haskell could've killed Susanna? Haskell killed women who abandoned their children.
Susanna didn't have a kid, but killers break their patterns all the time.
Yeah.
What did you need to tell me? They stopped looking for me.
That's what he said to you.
"They stopped looking for me.
" He meant the cops.
Once they had your brother, they stopped looking.
He took mine, so I-I-I took care of his.
And "He took mine, so I took care of his"! Right.
Danny took the fall for Haskell, so Haskell took care of Ruby.
What if the fourth man killed Haskell DeBray because he was scared of him talking? Maybe Haskell's number five.
Five what? W-What are you talking about? Well we think that this man may have been involved in the murder of Susanna.
W-W-W-W-Wait.
Danny said he took this picture.
But he couldn't have.
The camera broke that night.
Nobody ever took any film out of it.
But maybe he thought he did.
Maybe a took a different picture of them.
The film's still in the camera.
Danny got arrested.
He never took it out.
And the shutter was broken that night when he dropped it.
Ruby pretends to take pictures all the time, right, Mom? But it's just make-believe! Ruby's camera? It's at my office.
I'm fixing it.
We have to get it.
Jenny can pick it up.
I'll text her.
Okay.
Mrs.
Jackson, do you have any photos of that day? I would've given my life for a picture of Danny in town at the time of the murder.
I-I went to the papers.
I-I tracked down tourists.
I banged on doors.
You want photos? I got photos.
Look out, 'cause it's seven boxes.
Look at that.
That's Susanna.
The yellow scarf she was wearing in her hair that day.
The photographer from "The Clarion" took that.
He was following the girls with the sparklers down Main Street.
He gave me the whole roll.
Perfect.
Look at this.
Right there.
Look at the time stamp.
10:09.
She was dead by midnight.
Here.
Where was she going? Oh, no.
What? That's me.
I must've gone home with her that night and and And what? The bar is packed with drunk college kids.
The fourth guy could be in there.
Look at this.
At the other end of the bar Who is this with the video camera? Shelley Rocklyn.
It was her bachelorette party.
I remember hearing this loud, annoying racket to the left.
And that was the last thing I remember hearing at all.
She was playing with her video camera.
If Susanna met one of the guys, or all of them, maybe it's on tape.
Yeah.
Maybe.
Well, do you guys know where this Shelley Rocklyn might live? In the house she grew up in.
Her marriage lasted six weeks.
Eight, tops.
Nico, we have to go back to Spanish Harbor.
Yeah.
Serena, time to go! Get your shoes.
We're in a hurry.
I wanna stay here.
I know you're having fun with Ruby, but we'll see her again soon, okay? I can't leave yet.
Why not? I called Daddy.
He's coming over.
Well, um, we can't wait for him, sweetie.
Why not? Because Mommy's on a deadline on the story I told you about.
What story? There is no story! I wanna see Daddy, and I'm not going anywhere until you tell me the truth about why we're running around doing all these crazy things.
So forget about leaving because I'm staying here! [Door slams.]
[Tires screeching.]
He's here! Oh, God.
[Doorknob rattles.]
Serena.
Serena, open the door.
Serena, you have to come with me.
I'll explain it all to you later, okay? - Explain now.
- He's coming in.
[Gasps.]
[Tearfully.]
I I don't know what to do! She disappears tomorrow night.
He'll take her away from me.
He won't protect her.
- He won't - Honey.
Honey! Take your daughter.
Take her out the back, through the alley.
Now.
Serena? Come here.
[Door creaks.]
Serena, I said come here right now.
You listen to me, young lady.
Someday you'll understand all of this.
But right now, I have to make the decisions because I'm the grown up.
So you have to do as I say, whether it's fair or not.
So get your things, and we're going.
[Knocking on door.]
Mrs.
Jackson? [Knocking continues.]
All these years you have no time for me, and now I can't get rid of you.
I want to see my daughter.
They took off 10 minutes ago.
Laura! Serena! Serena! Laura! You can shout all you want.
They still won't be here.
That's my cellphone.
If you hear from them, please let me know.
It could be a matter of life and death.
Ruskin: Good afternoon, Governor.
The Department of Corrections sent you the order of executions prioritized by seniority and severity of offense, from number one to number 749.
This is devouring my agenda.
I have a landslide in Tulare County I should be visiting Chopper at the ready, Governor.
a eulogy to write for the Senator, a replacement to nominate.
I do not like ducking calls from the President of the United States.
Short list of candidates in the works.
What you need to do now is have a look at the D.
O.
C.
's pick for first to be executed.
Oh, Lord.
Sorry.
I'm just your Chief of Staff, Preston, not your priest.
[Dog barking.]
That time in fifth grade when you wanted to kiss me, I laughed at you 'cause you had gum in your braces? I shoulda said yes.
Maybe now I'd be Mrs.
Jackson, living an exciting life in San Francisco.
Yeah.
Beats me how this is gonna help you with your story, but knock yourself out.
[Indistinct conversations.]
Nico: Look, in the window.
Susanna.
No.
She came looking for me right when I was licking salt off the bartender.
What's wrong? It's okay, baby.
Everything's fine.
It's obviously not fine.
Laura: Is that guy following her? Wait.
Look.
Go back.
Stop.
It's the fourth man the tank top, the tattoo.
- He followed her.
He did it.
- Did what? I don't think you're supposed to ask.
We know he followed her.
We don't know that he did it.
Let's fast-forward.
[Indistinct talking.]
Look at the time.
[Indistinct talking.]
What time did Susanna die? - Cheers! - Cheers.
Before that.
But we still don't know who the fourth man is.
But, Nico, you didn't do it.
[Sighs.]
Let's go back.
He had to have come from somewhere.
There he is, coming out of that hotel.
Please tell me the Tidewater Inn is still there.
We walked by it this morning.
I'm sorry, but, uh Let me guess.
The records are missing for that whole week.
Close.
The The whole quarter.
Thank you.
They've erased everything.
The only thing they've missed is Shelley Rocklyn's bachelorette party.
Yeah, but who's "they"? Do I never get to have a shower again? [Sighs.]
Uh, sir? One room, please.
You girls get some R and R.
I'm gonna go track down an old police buddy who used to work in Spanish Harbor.
Thank you.
Maybe he can shed some light.
[Scoffs.]
Nico, wait.
Nico, look at me.
You didn't kill her.
Yeah.
I didn't hold the knife, but I held the door open for the guy that did.
I know, I know.
I I let Serena walk out to the parking lot without me 'cause I was busy with work.
It haunts me.
I never forget it.
Maybe this is why we were both brought back.
Because we're both chasing the same guy.
Maybe we're not supposed to split up.
Yeah.
I got to do this on my own.
Can we bring ourselves to execute a mentally disabled man? Ruskin: The jury was fully aware of Danny Jackson's disability.
The defense was built on it.
And it barely took them an hour of deliberations to convict.
Logan, talk to me.
As your son, or as your Director of Communications? The latter.
I need all the rational I can get.
Polls in the state are running higher pro-execution than they have in two generations.
But add in the low IQ, and yeah, some people won't like it.
What happens if I shuffle the order? Well, there's the crazy rub.
Then it looks like you're playing to the optics like it's about politics, not about protection and deterrence.
And what is it about? Protection and deterrence.
You all work with laws.
I work with victims.
The families who come to us accept, in time, that they won't get their beloveds back.
But they never stop hoping for justice.
Susanna was about to be engaged to her childhood sweetheart.
Carina was an art student of great talent.
Janice was rebuilding her life so that she could get her son out of foster care.
All younger than our son.
Serena: When are we going home? Soon, honey.
Daddy remembered your first-date anniversary.
He got you a surprise.
He did? Yep.
That's why he was coming over to Ruby's house, to get it so we could wrap it up.
That's sweet.
What kind of surprise? If I told you it wouldn't be much of a surprise, would it? [Suspenseful music plays.]
[Soft music plays.]
[Suspenseful music plays.]
Found them in the bathroom.
It was just a feeling you had? [Whispering.]
Oh, Tom.
What did you do? [Door opens.]
[Sighs.]
[Keys rattle.]
[Bottles clinking.]
Whoa! - You scared the crap out of me! - I try.
You know, there's a lot of people looking for you right now.
You gonna turn me in? I should.
Good thing we're old friends, huh? Good thing.
Why are you here, Nico? Well, I have proof that my mother's been right all along.
Thank you.
Danny didn't kill Susanna, or anybody else.
That's Wow, that's incredible.
- On what evidence? - It's a long story.
Got me thinking, though.
If Danny's innocent, how'd his DNA get on the victim's personal effects inside the lock-up? Could be a lot of ways.
What are you thinking? Well I do know Haskell DeBray killed Carina Markovich and Janice Kim.
I know that much.
- What? - Mm-hmm.
I also know that whoever killed Haskell right before he was about to tell all to Uncle Nico knew exactly where he was gonna be and when.
Makes you wonder, doesn't it? Dirty cop in Spanish Harbor, dirty cop in San Francisco.
Who worked for both divisions? Who was always in the right place at the right time? You're kidding me, right? The night Haskell was killed, you shot at the assassin.
[Engine revs.]
[Tires screech.]
You missed.
- Yeah, I missed.
So? - Come on, Cupcake.
You never miss.
You were the best marksman on the squad.
You had to be, to make up for what a giant goof you were - in every other area.
- Look, Nico Then there's Fremont Grove.
I told you I was headed that way, and surprise! - I get ambushed.
- Come on, Nico.
- You know me.
- Well enough to know you're full of crap.
If this was your case I wouldn't accuse anybody without proof.
[Phone beeps.]
[Phone ringing.]
[As Cupcake.]
Hi, this is Detective Kupner.
I'm calling about a bloody glove I dropped off in evidence.
Yeah.
[Gasps.]
I'm sorry.
My mistake.
Must've been a different lab.
[Phone beeps.]
[Sighs.]
Friends since we were eight, man.
You watched my brother grow up.
How much they pay you to put him on death row? - Zero.
- Come on.
- They knew stuff.
- What stuff? Stuff I'd done cash in my pockets from a bust, a tip-off on a raid.
That's how they got me to do big stuff by threatening to tell about the little stuff.
What kind of stuff? Putting my brother's DNA on the evidence inside of lock-up? That kind of stuff, Cupcake? I thought he killed Susanna.
You said he did it.
I believed you.
- So adding the other two - Hey.
Listen to me for a second.
Who's the man? Huh? Who muscled you? I don't know.
I swear I don't know! They don't tell me anything.
Okay? I got phone calls.
They own me, Nico.
And every time I do something else, they own me more.
I'm sorry.
I'm sorry, Nico.
Who's the guy with the tattoo? Who killed Susanna? Who? Hey, hey, hey.
What, it's come down to this now? You have no idea how big this is.
Take it easy, pal.
I can't do it anymore.
[Phone ringing.]
- Laura: Hey.
- Where are you? I got your anniversary gift early.
You shouldn't have.
I can explain everything.
When someone breaks the story about the D.
A.
stealing police evidence, you'll have a festival of explaining to do.
Maybe you can do it from the cell Danny Jackson's sitting in.
- What do you want? - Three things.
- Call off the cops.
- Done.
Meet me - somewhere public in an hour.
- Okay.
Sansom Tavern.
What's the third thing? Tell me everything.
Okay.
Where's your phone? Not this one.
A smaller one.
A secret one.
[Rummaging.]
Yeah.
All right.
Okay.
So, here's my thinking.
Haskell DeBray was killed on Friday right before midnight, right? So you found out he was going back to the station at what, like, 25 minutes before that.
So here's the call at 11:39.
- [Phone beeps.]
- Right on time.
[Phone ringing.]
You were my brother, man.
When I couldn't take it for one more second in my own house, I went to yours.
Your mom used to make me peanut butter and banana sandwiches.
Man: Yeah? [As Cupcake.]
Hey, it's me.
- What do you want? - I need to see ya.
I got something I wanna say, but I can't say it over the phone.
[Laughs.]
Right.
What do you really want? I need to see the man who shot Haskell DeBray, the man who clobbered my friend Nico on the roof.
Excuse me? He meets me at the salvage yard in Daly City in one hour or I talk.
I never took you for somebody with a death wish.
Actually, I've been dead 10 minutes.
I see him or I talk.
After we see Daddy, are we all gonna go home together? We'll see how everything goes, okay? - Angel? - Yes, Mom? Nothing's going to happen, but just to be extra, extra careful if we get separated and you see anybody with a tattoo like this, you run, okay? I'll call the police.
No.
Don't call the police.
Right now, we can't trust them.
Run and shout for help.
- Okay? - Okay.
Promise? I promise.
Okay.
Go try to use the bathroom before we go.
Okay.
[Door closes.]
[Motorcycle approaching.]
What do you want? [Grunts.]
Must've been how Susanna felt something around her neck she couldn't tear off.
What was it like to watch her die? You like killing women, huh? What about little girls? You like killing them, too? Who's behind this? Who? [Groans.]
[Grunting.]
[Car horn blares.]
[Grunting.]
[Horn blares.]
[Groans.]
[Engine revs.]
Hey! Hey! Hey! - Daddy! - [Laughing.]
Hey.
[Groans.]
- I missed you so much! - I missed you, too, sweet pea.
[Kissing.]
Come sit next to me.
[Sighs.]
Wave when you know what you want.
Okay.
What, um What do you want? For you to start talking.
Two weeks ago, Jes El cantante que nuestra hija ama came to me with evidence he'd been holding onto for 10 years.
Una bufanda ensangrentada.
which he said would prove who really hurt Susanna Spencer.
Why did he wait so long to come forward? Somebody scared him out of it.
But when he heard the governor was revving up capital punishment, he couldn't live with himself.
Who did it? Who is the real asesino.
He got nervous.
Wouldn't say.
Then he called me again and said he'd meet me and tell me everything.
But someone took care of him before he could talk.
Yes.
Y nuestra hija lavó bufanda.
before I could run the DNA.
Why are you talking Spanish? Stuff that's a little private.
Nothing to worry about, hmm? When you found the jewelry in DeBray's apartment, I realized Haskell killed Janice and Carina.
I need you to give me the jewelry so I can clear the person who's being punished.
But, why did you lo robaste? I was afraid the police were involved in the cover-up.
We're on the same side, trying to right a wrong from ten years ago.
So all this time, you've been trying to help Danny Jackson? Yes.
Unbelievable.
So you understand why I need the jewelry.
No.
I meant unbelievable.
Like the singer coming to your office and telling you some of the story, but not all of it.
- Tom.
- Hmm? At this point, do you know how I know when you're mintiendo? - How? - Your lips are moving.
Give me the backpack.
Please.
Or I'll have to do something that I do not want to do.
