I interviewed with the mother, Heather, when she was looking for a nanny.
And we spoke maybe ten minutes, but I didn't get the job.
Heather said she saw Elena at the park the day Tyler was kidnapped.
I didn't see Heather or her baby.
I was there for a run.
And did you tell the police that? Yes, but I don't think they believe me.
I didn't know what to do so I came to Father Dias.
And I realized she needs a lawyer.
During your interview with Heather, did anything hostile take place? [indistinct voices.]
Elena Vasco, you're under arrest for the felony kidnapping of one Tyler Kent.
This is a church, I invoke sanctuary.
Sanctuary has no force of law, Father.
Elena, I will meet you at the precinct.
You have the right to an attorney.
If you can not afford one, one will be appointed for you.
She has representation by counsel, Detective.
No questions! Sarah Holt's lunch tray.

I had a meeting with Kyle Hannon and his parents today, and when I brought up his two assignments that Kyle missed, his dad raised his hand, and Kyle reacted like he thought he was gonna get hit.
Did you think he was? No, but I The way he reacted made me think that it does happen.
If I suspect that a student is being abused, I have a professional duty to report it.

Vasco is released, we have reason to believe that she will ensconce the child, or worse, harm him.
The People have no basis for their belief, Your Honour.
Tyler's blanket was found buried in her yard.
Which we will move to suppress.

Back to the matter of bail.
Ms.
Vasco has no prior record, she has cooperated with authorities, and a prominent and respected priest from her district, a Father Felix Dias, vouches that she will continue to do so.
[bangs gavel.]
Counsellors, step up, please.
[quietly.]
If you haven't noticed, we have an unusual number of guests with us, just waiting for a screw-up to make their headlines, and I don't intend to give it to them.
So, Ms.

About a year ago, Elena Vasco had a baby of her own, a boy who died of natural causes shortly after birth.
It's possible that she kidnapped Tyler to fill the void left by the tragic loss or her own child.

This court orders a probable cause hearing to be held forthwith.
Until then, the defendant is remanded to custody without bail.

So let me get this straight.
You can't prove that she ever touched the blanket, it wasn't her yard, and all your witness knows about the hole digger is her gender.

Does the defence have anything else before I rule? Yes, only this: There are certain images, certain pieces of evidence which provoke a visceral reaction.
This is one of them.
Our concern is that if the jury sees the blanket, they won't be able to judge the facts correctly.
If we have any hope in reaching a rational verdict, this blanket must be suppressed.
Judge, you know it is not the key to this case.
Do not let the jury get this wrong.

Counsellor, when your client interviewed to be Heather's nanny, was it her plan all along to steal the baby? Or did that idea come after? My client did not take the child.

What I said Actually, I want your viewers to know that Elena, like Heather, is a religious woman.
But most critically, Tyler is still out there.

Instead of my viewers, shouldn't you be asking your client where Tyler is? A woman so desperate to replace the baby that she lost, that she would resort to this unthinkable act.
That is un- Heedless of the anguish and unbearable suffering she's inflicted upon another young mother.
Arguably, the deepest and most searing pain a woman can ever know! The agonizing loss of a child! [sobbing.]

Even the privilege has exceptions in cases of child abuse, and neglect Is the defendant now confessing to child abuse as well as kidnapping? My point is, in the interest of a child in danger, outweighs Heather's interest in privacy.
Tyler Kent is still out there.
If breaking privilege will help us find him, then you need to do that.

Whatever Heather told her priest, it wasn't that she hurt or killed her son.

So I've been looking online and a lot of people have been posting tips on where to find Tyler.
Some are crazies with twisted imaginations.
Something Ray would know a lot about.
But this one emails every hour, insisting Tyler is her baby, not Heather's.
That one has an attachment.
I know, I'm scared to open it.
That she's afraid of.
But getting naked in some strange guy's office, that's Okay.
What? We found Tyler Kent.
You recognize this photograph? That's one of the photos I released to the media to help find my baby.
And this one? [gasps.]
That looks like Tyler.
And this one? [murmuring.]
And this one? [murmuring continues.]
They are exactly the same photograph.
The only difference is the mother's face.
Her name is Zoe Keller.
Do you know her? Never heard of her.
Zoe Keller says that this baby is hers.
She is obviously a very sick woman with a copy of Photoshop and too much time on her hands.
Well, we would have thought the same thing, had she not sent us these.
[murmuring.]
Photos that bear no resemblance to any of the ones you gave us.
Can you do the same thing? Do what, exactly? Give us one photo of Tyler's that isn't exactly the same as Zoe Keller's.
And keep in mind that we have all of her photos on that computer right there, and that she is on her way here right now with her son.
One photo, Heather.
One photo that isn't exactly the same as all the ones that Zoe Keller posted online.
Objection, badgering the witness.
Overruled.
We're waiting, Miss Bell.
I I can't.
You can't, because the truth is, you stole Tyler's photos from Zoe's online profile.
You photoshopped them.
You never had a baby, did you? You made up the entire thing for a boy.
And it almost worked too, didn't it.
Matt came back to you.
He wanted to be a family.
He came back to see his child.
So you panicked.
You made up the whole story about a kidnapping.
You interviewed Elena for a nanny job that did not exist! And then you buried the blanket in her yard.
You set her up to take the fall.
I I didn't mean for it to blow up like this.
[sobbing.]

The reason I didn't hand in those assignments was because my dad got moved to the night shift.
