Chapter Sixteen

Previously on The Firm Ah! I'm calling about a woman named Abby McDeere She's been found.
We found the room where you were being held.
Now, the water and the white cloth.
Were they used? Sometimes I feel like I can't breathe.
You need to tell Mitch.
I'll tell him when I'm ready.
We arrested Kevin Stack.
He might have a lot to say about the lawyer who failed to keep him out prison.
I recorded every conversation you and I ever had about this mission of ours.
It's worth it to me to have a lawyer so motivated.
The defence will be moving to suppress the hard drive taken from my client.
- On what grounds? - On the grounds that it was stolen.
The hard drive is excluded; Mr.
Stack is free to go.
You have to testify.
Stack was there, wasn't he? You saw him give the order.
I saw him do more than that.
Kevin Stack, I'm arresting you for the murder of Andrew Palmer.
I didn't know you had a case for Andrew! I didn't know we had a witness.
Who? Me.
It's just different now.
We were young when we got married.
We went to the same high school.

Yeah, I get it.
I mean, I met my wife in law school, she was 20, I was 22.
I resent him.
I know that's a crazy thing to say.
You were tortured, Abby.

He gets involved in these insane situations and then, instead of walking away - He won't quit.

All we need to establish is enough to convince the judge to hold Stack for trial.
I will call you to the stand, walk you through the facts I'd like to start with how you were abducted.

The court needs verbal responses for the record.

And the men who grabbed you had you ever seen them before? It's just a probable cause hearing.

She was arrested last night for murder.
The court assigned her case to a local lawyer named Mitch McDeere.
And? Thought you might recognize the name.
Solo practice? Married with a daughter? Plays in a basketball league for attorneys? So do I.
Yes, Andrew, now you know why you're here.

Your Honour, in light of your ruling excluding the hard drive defence is seeking to limit the scope of this hearing.
- Limit it how? - To the issues at hand.
My client is charged with ordering the murder of Andrew Palmer.
As well as the abduction and torture of Abigail McDeere.
Any testimony should go to those crimes alone.
The contents on that drive, and any conspiracy to murder Noble Insurance patients should be off limits.
I'm with you, Miss Clark.
If the hard drive is out, I'm inclined to keep it out.
- That's a mistake, Your Honour.
- Excuse me? The hard drive establishes motive.
The defendant abducted Mrs McDeere to trade her for that drive.
With all due respect, motive isn't the issue here.
I agree.
Why is not an element of the crimes.
If your witness saw it happen, counsel, you don't need the drive to make your case.
Your Honour, our burden here is low.
And if we don't get a fair hearing, my office will look into why.
Well, that's a first.
I haven't even ruled yet, and already I'm being threatened.
There will be no mention of that hard drive.

When that bag was removed, that's when I saw Mr.

Who else was there? Another man, a former soldier of Mr Stack's, and Andrew Palmer.
His hands were tied and he was sitting in a chair opposite me.
Mr Stack said he wanted the hard drive.
Objection.
We're not offering the contents, Your Honour, she's testifying to what he said.
I'll allow it.
Andrew said he didn't know where it was.
You know what, Andrew? I believe you.
And since you don't know where to find the drive I don't need you anymore.
No! No! He gave the order.
He nodded to the other man who was there to kill Andrew.
And he did it in front of me.
What happened then? The man, uh He began the process of questioning me about the whereabouts of the drive.
What kind of questioning? He placed a cloth over my nose and mouth and water was poured over it.
My client wasn't there when you were abducted No, but he talked to my husband, and he sent a video link - Objection - Move to strike.
Hearsay.
No video link was ever found or placed into evidence.
Sustained.
You were tortured, waterboarded, that's your testimony? Assuming it even happened, my client wasn't there either, was he? No, he left before that happened.
Are you sure? Are you sure he was ever really even there? If you were tortured, maybe you imagined my client was there.
You were in shock.
He was there before I was tortured.
Can you prove it? Do you really expect us to believe that you had a clear sense of time? I know what I saw.
He gave the order for Andrew to be killed.
The order? By your own admission, he didn't say any words.
You think he nodded his head.

He wasn't even there, Abby.
You imagined it.
- Objection! - Sustained.
You admit my client didn't pull the trigger.
The other man did.
What exactly happened to this other man? The witness will answer.

I liked him very much.
And the charges relating to Abigail McDeere? I can't say much there, except that I wasn't involved.
She's clearly a distraught woman.
I believe she believes I was there, but I wasn't.

Stack? You killed all those people - Objection! And here you sit, mocking us all? Sustained! Let's keep it about this case, counsel.
You kidnapped Abby McDeere to trade her for that drive.
You had her taken to a warehouse and tortured.
You can't prove that.

Evidence that includes the contents of that drive.

I'm Rodham.

There were no defendants on tap when I got here.
You McDeeres just don't know when to quit, do you.

To be the strong soldiers we once were, and still are.

His job application says he has an ex-wife and a six-year old son.
His son is the beneficiary on his pension.
We have an address for the mom and son.
- So how does that help us? - We don't know yet.
I looked up the address, it's a row-house but it's not registered to the mom's name.
I checked with my credit card connection, he says nobody with the mother's name there gets bills.
So maybe she doesn't have a credit card.
Possibly, but credit cards are hard to avoid unless - Dimitri! You sure? All right, thank you.
So you know how Dimitri works at that bank? He has access to all kinds of tax records.
He says that nobody with that name at that address has filed tax returns in the last five years.
We need to talk to her.
Your flight's gonna leave in an hour.
We're not leaving 'til we know he's okay.
Is this how you imagined it, Kevin? The end of your missions? You running? Forced to leave the country you spent the better years of your life defending? I gotta hand it to you.

This pill cost $300! And it won't work! So what! Take it! Procedure cost 400,000! And you'll probably die on the table! Doesn't matter! Do it! We're all about hope! So that's what this is all about? Waste? What's being wasted is life.
You just can't see it.
STACK: You're not serious.

We're haemorrhaging cash.
Co-pays need to go up.
We can't do this.
Pre-natal care? All those meds? Sir, if pregnant women can't afford the co-pay, they won't get pre-natal care.
And no pre-natal care means dead kids.
Look, I get it, Kevin.
But this is a business.
And we have only so much money to work with.
What about the meds? People need these drugs to live! If we make them unaffordable - Look You want the company to pay for this? Then find us a way to save the money somewhere else.
STACK: Cause and effect, Mitch.
Every dollar we waste stops us from paying for someone to get what they need.
You think I'm a killer.
People who could be living full lives are dying so that we can keep patients who won't last a year alive.
I'm shifting the balance.

I'm Tammy Hemphill, that's Ray.

If Rodham goes to jail for helping Stack, the mom gets deported.
That means the son goes into foster care.
That's our leverage.
So Rodham's wife is illegally here.

Just play the card, see if he folds.

We're fuelling up now.
Half an hour.
We're almost done, sir.

Every killing since this started was done in service to the mission.
We kill to save.
We end one to save hundreds.
Our mission is over, Sergeant.
So is the killing.
Stand down.
Sir Stand down! I'll meet you outside.
The system may be broken.
But murder? You killed those people.
You can tell yourself whatever you want, Stack, but you're wrong.
My world's not so black and white.
So you think you're God now? I'm a soldier.
I'm doing what every commander on the battlefield does.
Making choices.
Every war requires some sacrifice.
You are not on a battlefield, and this is not a war, but yes, you are a commander.
And what happened to 'no man left behind'? If you leave a man behind enemy lines, you go get him.
You send a platoon to rescue him.
Why? More may die trying to save him.
But you do it.
Because it's not just about numbers.
'America believes in miracles'.
If someone's gonna die, then let's try and save them.
But not by giving up on others.
Yes we believe in miracles.
And that's why every once in a while, we get one.
Drop your weapons! Hands in the air! Let's go, let's go! COLEMAN Kevin Stack, This is the US Federal Marshall Service.
We have the building surrounded.
You come in here I will kill McDeere! Kevin, it's over.
They don't understand.
Nobody'll understand.
I've seen people die.
I've held them, looked into their eyes when the lights went out.
It doesn't end.
The people we've killed We moved them on to what's next.

We're healers.
