Trial & Error (2016) s02e07 Episode Script

A Family Affair

1 So I got Lavinia Peck-Foster off for murdering her husband.
The problem is, she murdered her husband.
To right that wrong, I now represent Town Garbage Fire, Jesse Ray Beaumont, who was convicted of killing Lavinia's brother nine years ago.
I've gotten subtle hints that not everyone is happy I'm reopening this case.
- [CLICKS.]
- [GLASS SHATTERS.]
[SCREAMS.]
But I truly believe that Lavinia killed her brother Chet, and when I prove that, I will be getting justice for Jesse Ray Beaumont and justice for Lavinia Peck-Foster.
And no matter how you feel about either of them, no one can argue with justice.
Peckers are asking, "Where is the justice?" as East Peck's original "Trial of the Century" is being reopened by briefly-liked lawyer Josh Segal.
Nine years ago, the seven-month trial riveted the town, cutting what was already the nation's shortest school year to a single week.
Nine years ago was my third swing through tenth grade.
I was real popular 'cause I just turned 21.
That was a pretty sweet week.
The Jesse Ray Beaumont trial was my first day as a court reporter.
The guy in the suit with the hair was angry, and the woman in the hat was sad.
And it was my last day as a court reporter.
[HIGH-PITCHED, INDISTINCT TALKING.]
[DEEP VOICE.]
This is going to be my last case.
I'm going to be singing baritone at Lincoln Center, provided I don't lose my voice.
[LAUGHS.]
[BLEEP.]
It was my first big trial.
I was a junior attorney with my whole future ahead of me.
I'll [BLEEP.]
your teeth in your Goddamn throat, Jesse Ray! You know I don't need your [BLEEP.]
town, your little [BLEEP.]
town.
I'll beat the [BLEEP.]
D.
A.
and [BLEEP.]
I am a much bigger person now.
JOSH: Nine years ago, I was interning at the biggest law firm in Manhattan.
Every one of these people who interned with me are millionaires now.
They're all married, kids.
Me? I'm doing my third big case in a row for no money.
[SIGHS.]
[BLEEP.]
me.
- Morning, Dwayne.
- Morning, Anne.
- Hey, any messages? - ANNE: Just the usual.
A bunch of hate mail and several boxes of feces.
- I put them on your desk.
- [FLIES BUZZING.]
And I couldn't get the arrow out of the bear, so I turned it into a nature scene.
Well, thank you, Dwayne, and thank you, Anne.
Now, Carol Anne Keane is seeking the death penalty, and Jesse Ray's life hangs in the balance.
But we can save him if we prove that Lavinia was the one who killed Chet.
This is a classic underdog story.
It's like David and Goliath.
- You mean David and Glenn? - Who are David and Glenn? David is little, and Glenn is big.
Glenn got my sister pregnant.
Good guy.
Sure.
David and and Glenn.
David is who we are, right, 'cause David is the underdog who did not get Dwayne's sister pregnant.
Not for lack of trying.
Reopening this case has been a godsend.
By taking on Jesse Ray, my poll numbers have tripled.
Imagine what'll happen when I put him to death.
[LAUGHS.]
Suck it, Dem Nutz.
It's a long race.
All rise! Actually, I need to talk to Lawyer, and we need some privacy.
That is not how it works.
[HIGH-PITCHED, INDISTINCT TALKING.]
All leave.
Uh, Lawyer, I felt like we had something, then all of a sudden, you turned cold.
What happened? You killed a lot of people.
Oh, right.
Never forget.
Too bad.
You could have had all this.
Some of this.
Ohh, most of this.
This on Sunday.
This on your birthday.
I know that you killed Chet, and I am going to prove it.
And for the record, I got a bike for my birthday, and as soon as I get a helmet, I am going to ride it to visit you in jail.
We're done here.
LAVINIA: Pecks don't get mad.
We get even madder.
Your Honor, as highest-polling candidate for D.
A.
in this room Don't get cocky, Keane.
This is my moment, Mr.
Nutz! [SLAMS HAND ON DESK.]
the people ask that bail be set at $1 million, seeing as the defendant is clearly at risk of running.
I will never run! Running is a fictional sport sold to us by the tight-clothes industry.
My current client is far less a flight risk than my previous client, whose bail was set at $10.
Your Honor, Mr.
Ray Beaumont deserves the same rights as the most prominent Peckers.
This case is the Have Nots versus the Haves.
Weak versus strong.
David versus Goliath! He means Glenn.
[SPECTATORS MURMUR.]
He got my sister pregnant.
Your Honor, the People know this man is innocent.
Frankly, the Defense thinks the People should be kinder given the Defense might have put that baby in the People.
Fine.
The People are willing to set bail at $100.
I didn't want to manipulate Carol Anne Keane like that, but these are high stakes.
Provided Mr.
Ray Beaumont is released into the custody - of his attorney.
- What's that now? If he thinks he can manipulate me, the Defense does not know what kind of person the People is.
[HIGH-PITCHED, INDISTINCT TALKING.]
[GAVEL BANGS.]
What did the judge say? If I can make bail, I can live with you.
[CHUCKLES, LAUGHS.]
- [GATE BUZZES.]
- You don't have $100? No wonder she's still pregnant.
[GATE BUZZES.]
This guy defends immigrant children against deportation.
Ryan Gosling's gonna play him in the movie, so we're both doing good.
Josh? Where do you want me to put these feces? I'll take it.
Oh, I have way more.
Thanks.
[SPLAT.]
JOSH: In order to prove Jesse Ray's innocence, I need every piece of evidence from the first trial, so we are going to talk to Jesse Ray's original lawyer, Dr.
Rock N' Law.
Are you in a jam with the law? Have your legal problems given you the blues? Then it's time to see the doctor.
Dr.
Rock N' Law! Call or text while you're driving your car.
I'll fight for you.
Specializing in vehicular manslaughter caused by texting and driving.
Dr.
Rock N' Law! Wow.
What a nice office.
I guess law firms don't have to be in a taxidermist, Josh.
We'll make this quick because I'm getting high just sitting here, and your robe just came undone.
We're reopening the Jesse Ray Beaumont case.
Do you think Lavinia killed Chet? I'll answer your question with two questions.
Who's Lavinia? Who's Chet? Well, back then, my firm wasn't parked as close to the court.
I had a roughly nine-joint drive, depending on traffic.
Here are all my files on the case.
[PAPER RUSTLING.]
These are mostly just song lyrics and taco wrappers.
Dr.
Rock N' Law, I am asking you as a professional courtesy, please close your robe.
Rock 'n' roll is my method.
I get my inspiration from the case, and I put it into righteous tunes.
Everything you need to know about the case is on this CD.
It's the best-reviewed album of my career.
Great, you can just hand those to Dwayne or Anne.
DWAYNE: While Dr.
Rock N' Law seems legit, we're worried that somebody who took a nine-joint drive every morning may have not provided Jesse Ray with adequate counsel.
So Anne and I are gonna try it, see if we can still do our jobs.
Usually, we leave no stone unturned.
Today, we're leaving no turn unstoned.
[HORN HONKS.]
[COUGHING.]
Come on.
I'm already two ahead of you.
JOSH: Normally, I would visit my client and go through files in person, but every time I go to visit Jesse Ray, he tries to pass me a note from his mouth to my mouth.
Including once in my car.
So now we have a phone relationship.
[PHONE CLICKS, BEEPS.]
[DOOR BELL CHIMES.]
Hey! Guys, we're supposed to be working today.
We were.
We were trying to re-create the the nine-joint drive.
- How far did you get? - Zero feet.
What look [LAUGHS.]
When did all these animals get here? You know that we have a zero-tolerance drug policy here at the office.
That's why we said Dr.
Rock N' Law is way cooler than you.
Well, I can live with that.
That actually hurt.
And by the way, drugs don't make you cool.
Jesse Ray told me that a week before the murder, Chet and Lavinia got into a fight, something about a tree.
Well, while you guys were smoking drugs, I did some research.
Turns out the timber rights to Peck Gardens are worth over $2 million.
I bet that's what they were fighting about.
Be sober, be sharp.
Or maybe it was a family tree.
Family tree.
"Guilty as Charged," third track, "Family Tree.
" Family tree, family tree I'll kill you if you talk about the family tree Huh, yeah, well, you know, maybe it's that.
This insight brought to you by marijuana.
[LAUGHS.]
Okay.
So, let's put together Lavinia's family tree and see if it leads anywhere.
What do we know about Lavinia's family? Why don't we just visit Kerri Rasmussen, Peck County historian? I would have gotten it.
Stay in school.
Fighting? Chet was my brother.
We were close, even as kids, and we stayed close right up until the day he was brutally murdered by Jesse Ray Beaumont.
Oh, this whole thing is so upsetting to me, I don't know whether to break something or to faint.
- [SCREAMS.]
- [PLATE SHATTERS.]
[SIGHS.]
Anne Flatch.
I haven't seen you in years.
You look exactly the same.
[LAUGHS.]
And you're unrecognizable.
I still can't see faces, but your body seems older.
JOSH: We're interested in the Peck family.
Ahh, I have lots on the Peck family.
Specifically, we're looking for information on the Family tree, Family tree I'll kill you if you talk about the family tree Dr.
Rock N' Law fan.
I followed him one wild summer on tour.
In fact, he wrote a song about me.
Oh, my God.
Is this where the song "She Had A Giant Box" comes from? Sure.
Lavinia's father, Francis, was the tallest of 12 children at 4'10".
And her mother, Lavinia Sr.
, was famous for her homemade sweet tea and her racist puppet shows.
Now, wait.
This is Lavinia.
This is Chet.
Who is Trig? Lavinia's youngest brother.
Why would Lavinia never mention that she had another brother? - Whatever happened to Trig? - No one knows.
Shortly after he was born, he was sent overseas to Spain.
Could this be what she and Chet were fighting about? - A secret brother? - I doubt it.
They probably weren't very close to Trig.
He was 16 years younger than Lavinia, and she wasn't living at h om the year before he was bor.
Where was she living? [BELL RINGS.]
I think we figured out Lavinia's secret.
Yeah.
She went to fat school.
JOSH: I think we found a motive.
Lavinia got pregnant as a teenager.
Her parents covered it up by sending her away to have the baby and then shipping the baby off to Spain.
Chet found out, threatened to divulge her secret.
[SNAPS FINGERS.]
So Lavinia killed him.
That's the argument Jesse Ray heard, - which explains track 3.
- [CLICKS.]
DR.
ROCK 'N LAW: Family tree, family tree I'll kill if you talk about the family tree It's all about the baby, baby Turns out, Dr.
Rock N' Law might actually be a genius.
She had a giant box It could fit seven No.
I would like a warrant to search Peck Gardens again.
We are looking for evidence that Lavinia had an illegitimate child and that Chet was blackmailing her.
Unfortunately, Lavinia is not on trial here.
As you recall, you got her off for murder.
This is just another one of your schmear campaigns.
It's smear, and you know it.
And Lavinia is a suspect in this case.
[HIGH-PITCHED, INDISTINCT TALKING.]
Come on, Alex.
That is pig spit.
[HIGH-PITCHED, INDISTINCT TALKING.]
What about The People vs.
Ormush Peters? [HIGH-PITCHED, INDISTINCT TALKING.]
Thank you, Your Honor.
- Okay, what happened? - You won, then you lost.
You should have said something.
Hello, Lawyer! Excuse me.
This is a closed session.
Not for me.
I paid for this clubhouse.
This is a courthouse, not a clubhouse.
Then why do I have golfing clubs? Orange Lawyer, I'll see you later today at the big announcement.
I'm endorsing her for D.
A.
That way, she can focus on keeping a murderer off the street.
Bye, Lawyer.
Beep, beep, beep.
Oh, do not judge me.
A lot of voters aren't taking me seriously as a candidate.
But Lavinia's a murderer.
Didn't stop you from representing her.
I didn't know she was a murderer back then.
What you are doing is immoral.
Watch who you're calling immoral, [BLEEP.]
jammer.
You are no better than I am.
At least my intentions are true.
I said I would marry you if the baby was mine.
I even got this little buggy that I can tow behind my bike, but I cannot find one helmet in this entire town.
I'm talking about risking Jesse Ray Beaumont's life in order to make yourself feel better.
Which, by the way, would be a turn-on, if you ever stop talking about your stupid bike.
[SCOFFS.]
Carol Anne Keane is wrong.
Maybe I did take this case to get back at Lavinia, but I am also getting justice for Jesse Ray.
And my bike is not stupid.
- [HORN HONKS.]
- MAN: Watch it, [BLEEP.]
Jesus.
Nice bike, dweeb! But riding without a helmet is.
I have a theory that Chet was blackmailing Lavinia, and that's why she killed him.
Did you ever hear them mention a Trig? Mm, don't think so.
Maybe the giant box can help you.
We talked to her.
That's how we found out about Trig.
Her? No, I'm talking about the giant box Chet gave me right before he died.
Big enough to fit seven rocks.
Of course.
What was in the giant box? No idea.
I dropped it in the pond behind my house right before I was arrested.
I got the key in me if you're interested.
Wow, that would be great.
Please don't pass it to me through your mouth.
[LAUGHS.]
That'd be disgusting.
- Hang on.
- [SNAPS CLICKING.]
Well, it's sure nice to meet you today.
It's very nice to meet you, too, for the first time.
[LAUGHS.]
Wait, you meant "on" you, right? "In" me for the last nine years.
[INHALES SHARPLY.]
[HUMMING.]
Married millionaires.
Me.
So we took the key that was in Jesse Ray to the pond that was in his backyard to get the giant box that was now in our office.
Stand back.
I'll open it.
ANNE: The key's right there.
- Let's use the gun this one time.
- Okay.
Whoa, seven rocks.
- And a tape.
- Wow.
Finally being the only law firm in the country with a VCR - is paying off.
- Mm-hmm.
- Anne, let's put the tape in.
- No! I'm recording my stories.
WOMAN: How could you, Troy?! So, Troy was the killer all along? - No, it was his twin brother.
- What? Can we now watch the tape the victim hid before being murdered? I don't know, Josh.
I'm kind of TV'd out.
[VCR CLICKING.]
Okay.
"Memorial Day, 1983.
" What could this be? I can't.
It's not ladylike.
That's Lavinia.
And my daddy says it will lead to bad things.
MAN: Oh, come on, Lavinia.
I tell you what.
Just a little peek? I'll count to three.
One, two, three.
- Oh, see, that wasn't so bad.
- I guess not.
- Want to go [BLEEP.]
in the maze? - Okay.
[ LAUGHS.]
Hey, those are my flags.
Lady driver.
Lady driver.
Lavinia had an affair with her Flag Boy.
I bet this was Trig's father, and this tape proves that Chet knew.
We are getting very close to justice here.
[TAPE SPINNING RAPIDLY.]
Oh, come on, man! No, no, no, no, no! Could you imagine if those were my stories? I would lose it.
It is my great pleasure to announce that I have received the backing of a giant in our community, Ms.
Lavinia Peck-Foster! - Whoo! - [REPORTERS MURMURING.]
Could someone please move this little building? - CAROL: Yep.
- [SCRAPING.]
Thank you.
I hereby thrust my full womanhood behind Orange Lawyer, and I know she will do everything in her power to execute justice as well as Jesse Ray Beaumont.
Won't she? Won't she? [SINGSONG VOICE.]
Won't she? [LAUGHS.]
[NORMAL VOICE.]
She will.
- Thank you, dear.
- [APPLAUSE.]
REPORTER: Ms.
Keane, will you please tell us more - about your one-strike rule? - Oh, gladly.
And can I just say how refreshing it is to be finally talking about the issues and not about me being a [BLEEP.]
[BLEEP.]
- [MOANING.]
- [BLEEP.]
I think I'm in labor.
Oh [BLEEP.]
I'm [BLEEP.]
No further questions.
Are you more qualified than Atticus? [PANTING.]
[BLEEP.]
I'm so glad that you've asked.
The only mystery left is who is Lavinia Peck's baby daddy.
Now, all Flag Boys must be registered with the DMV, so I will log into my police account, which gives me access to their records.
I have Lavinia exactly where I want her.
Why did you call me here, and why are you smiling? I know why you killed Chet.
- You can't prove anything.
- Oh, but I can.
I found the giant box.
- She's a liar! - Not her.
Before he died, your brother gave Jesse Ray a key to that box.
And in it was a tape from 1983 of you with a certain Flag Boy.
I see.
That still doesn't prove anything.
Do you know who that Flag Boy was? Do you? Do you? Do you?! Her Flag Boy's name was A.
Reed.
Wasn't your dad's name A? It's pronounced "Ahh.
" But it's spelled the same way.
What's your point? Wasn't he also a Flag Boy? Only during the spring of '83, about nine months before my birthing day.
You did the worst thing a Peck could do.
You sullied the family bloodline, and Chet threatened to expose you.
That's why you killed him and framed Jesse Ray Beaumont.
I guess you know everything then, don't you, Lawyer? I guess I do.
And this guy? He took on the most powerful person in town to save the life of an innocent man.
And he has a really cool bike.
What if Lavinia is your mom? Oh, that's impossible, Anne.
I was told my mom died two months before I was born.
Do the math.
No.
Then you must know I wasn't in the country when Chet was killed.
Here is my passport with a stamp proving that I left for Spain on Saturday, November 15th, the day before Chet died.
But Lawyer knew that, didn't he? Didn't he? Didn't he? He didn't.
Dwayne, I think you're Lavinia's secret son, Trig.
Holy Reed.
I'm a Peck.
