Rise and Fall

Breathe, breathe Fran, okay? Deep breaths.
I'm trying.
My throat's all clogged.
Fran, listen I want you to close your eyes.
Okay, picture a beautiful place that you've been to.
I I can't.
I can't think of anything.
Just keep going back in time then.
Mohonk.
That's in the Catskills, right? Me and my mom used to go hiking there on Sundays.
There's a lighthouse on top of the mountain there.
Used to be anyway.
There still is.
I've been there.
It's lovely, isn't it? I know what you're trying to do! I can't go out there! Yes, you can.
Okay, we're going to do this together, Fran.
Take my hands.
Just look at me, okay? Just keep your eyes on me.
Come on, Fran.
That's it.
That's it.
You're doing great.
That's good Fran, stay with me.
Okay? That's it.
Fran, my eyes, look in my eyes, okay? Stay with me.
Stay with me.
Eyes on me.
Eyes on me.
That's it.
That's it, Fran.
You're safe, Fran.
It's okay.
Come on.
- Is there somebody I can call for you? - No, not really.
These folks are going to take you to the hospital, okay? I'll be fine.
I just I just need a minute You've suffered a severe trauma.
You're in shock right now.
I'll come visit you at the hospital.
- You promise? - I'll be there.
Our missing person is Ariana Murphy, a victim's advocate.
She got called to a double murder, never made it home.
Her partner called it in.
The victims are dead.
It's a little late for an advocate.
Well, she went to get a statement from the eyewitness: one Fran Costello, who was also the target.
- Who's after her? - An abusive husband.
She'd moved in with her brother.
Her husband showed up and went postal.
- Shot the brother and his wife.
- And what do we have on him? Well Andrew Costello has got arrests for spousal battery.
The locals have an APB out on him.
Costello didn't like when anybody came between him and his wife.
Maybe he's the one that went after our missing person, too.
Doesn't look like he knew her.
This was her first contact with the wife.
We've got no shortage of suspects.
I mean she counseled 192 victims of violent crimes over the last year.
We've got a husband in the wind who killed two people.
It's pretty obvious that he's the one we look at first.
It's always obvious when you take it at face value.
Without A Trace Season 7 Episode 05 "Rise and Fall" - Who is he? - Andrew Costello.
He's related to the last case that Ariana worked.
- Have you ever seen him before? - I don't think so.
I knew something like this would happen.
She deals with a lot of domestic violence victims, helping the women through court appearances and custody hearings.
Has she received any threats? - Not that she ever told me.
- What about from her own life? I mean has she had any abusive girlfriends? Why would you even ask me that? Well, sometimes people in her line of work are drawn to those jobs because they know what it's like to be victimized.
No.
I know most of her exes, and none of them are that way.
But when she was a kid her mother was stabbed to death.
Ariana saw the whole thing.
She was ten years old.
Who did it? Her mom's boyfriend.
And would you happen to know where he is now? In prison, last I heard.
Can you think of anyone that she may have had trouble with lately? There was something about a week ago.
It was our first night out in a long time.
I ordered you a Martini.
You are the best.
I'm sorry I'm so late.
That's okay.
I'm just glad you could get away.
Maybe I can redeem myself with this.
Ariana, oh my God.
Thank you.
What's the occasion? You know, just thinking of you.
You decided not to quit.
Val, I really agonized over it.
You said SUNY has a great psych program.
You already got accepted.
It's take two years to get my master's.
And then I'd have to go get my hours.
You can open your own practice.
- Think of all the people you can help.
- I'm helping people now.
People that really need it.
Yeah, and is this how they thank you? Clients get emotional.
Things things happen.
You are losing yourself to this job, Ariana.
I can't walk away.
Her job's been a sore subject.
And do you know who gave her the bruise? Who's Curtis Riegert? He murdered Ariana's mother.
He was released from Huntsville two months ago.
So why go after the daughter? Because she's the one who testified against him and put him there.
He's in town? Well, he's supposed to be in Houston, but his parole officer says that he's gone AWOL.
What else we got here? We're thinking Ariana may have had an altercation with one of her clients last week.
And we're dealing with the 12 cases that she was handling at the time.
- What about Andrew Costello? - He's still out there.
We don't have anything else that links him to Ariana.
We got any agents working that angle? It's a collective effort.
We're working every angle.
So, in other words, no? - Right.
- Yeah, well, make it yes.
Fran, I'm Agent Fitzgerald.
This is Agent Spade.
- Did you catch Andy? - Not yet, but we will.
What he did to Tyler Diane I still can't believe it.
You know, Ariana Murphy is missing.
Missing? I just saw her last night.
Yeah.
She disappeared after she left the crime scene.
It would really help us to know what happened when you were with her.
I was too messed up to talk.
So the cops called her in.
Fran You're safe now, okay? I want you to know that.
There are at least ten police officers in the next room.
What about Tyler and Diane? I'm I'm sorry.
Fran, I know it's hard, but you need to tell me what you saw.
We were just hanging out.
Fran open up the door.
Don't answer it.
Then what? - He's going to keep knocking.
- I told you this would happen.
I told you.
Look I know you in there.
- I'll handle this.
- Tyler Go hide.
I'll tell him you're not here.
I'm not getting around Fran.
Go.
Hurry.
Open this Door.
Before I kick it down.
Where is she? - Look, man, she's not here, okay? - Get out of my way.
Get out there on my house.
Where is she?! Don't shoot.
Don't shoot.
Please! Please! Please! Stop, please! He killed them.
And I just sat there.
After that the cops came, then Ariana.
Was that the first time you met her? No.
A friend gave me her name, and we got together last week at a coffee shopin Flatbush where she hangs out.
I was sick of my husband knocking me around.
And I wanted her to give me some advice on how to leave him.
Was your husband aware of this meeting? Yeah.
He found her card in my purse So he knew all about her.
You think Andy took her? What I do think is that you need to stay right here until we find Andy, okay? Hey, Jack, we talked to the manager at the coffee shop out in Flatbush.
Ariana stopped by at 3:00 A.
M.
That's just after the double murder.
What was she doing there? Drinking a cup of joe and decompressing.
Looks like Andrew Costello was there, too.
The manager ID'd him from a photo.
Were they together? No.
He just remembers Costello being parked out front.
It's not hard to do the math on that one.
- Nope.
- Everybody! Everybody, listen up I need your full attention.
and her sister were waiting for their mother outside one of the stores.
The victim has been identified as Madeline Ross.
Once again, this is the scene at Ridgeville Mall in White Plains where a four-year-old girl has just be kidnapped.
She is blonde, 38 inches tall, and was wearing a red shirt with an owl design, a skirt and yellow boots.
She was seen leaving the mall with a white male in his 30s.
Anyone with any information should call the number on screen or Madeline Ross was abducted 27 minutes ago.
We need to get on this.
Are we all be assigned at the Madeline Ross case? Taylor and Spade are already en route to the mall.
What about Ariana Murphy? I'm getting a lot of pressure from upstairs.
I never, ever had pressure from upstairs to dump a case.
There's a missing child here.
Every second counts.
We also have a woman who's been abducted by a violent and unstable person.
We need manpower to find her.
He's already killed two people.
He's got nothing left to lose.
- She's already dead.
- We don't know that.
Well, we will when her body turns up.
I'm putting all our resources where they'll do the most good.
No, you're just picking the sexier case.
It has a better payoff, doesn't it? This isn't about me and my career.
It's about saving Madeline Ross.
You're not picking the cute little white girl and dumping the lesbian because it's got a bit more play in it.
I'm not the only one who's gonna notice.
It's gonna bite you in the ass.
Are you threatening me? You know what? Take the case, wrap it up in an hour.
Guys, guys, look Let me hang back and close the Murphy case, all right? Jack is the best in the business when it comes to missing kids; you need him on the Ross case.
- Work for you? - No.
Well, it works for me.
One hour.
Witnesses saw the man put a ring on Maddy's finger and lead her away.
- We have his description? - Yeah.
"White male, mid-30s, medium build, wearing khakis and a polo shirt.
" That narrows it down to about half guys in this mall.
What about video? Danny's going through it.
That's the family.
Mr.
And Mrs.
Ross, I'm Agent Medina.
This is Agent Malone.
Is there news? Not for the moment, but it's very important that we interview all of you.
Of course.
- Well, separately.
- Well, is that really necessary? This is the most efficient way for us to get the information we need.
So no decedents named Ariana Murphy? Yeah, I'm looking at them right now.
And these are all the Jane Does since last night? Okay, if anyone comes in matching her description, you'll let me know? Great, thank you.
Agent Fitzgerald? The phone records you ordered for Andrew Costello, sir.
Right, thank you.
- Hello? - Mrs.
Costello? Hi, this is Agent Fitzgerald with the FBI.
If you're calling to ask where my son is, I don't know.
Are you sure about that? Because according to our records, he called you an hour ago.
- That's not true.
- Mrs.
Costello.
I'm looking for a missing person, and he may have seen her.
You talked to him.
What did he say? Hello? Damn it.
Look, Costello called his mom.
I want you to pull her phone records and find out who she called.
Thank you.
You should be looking for Maddy instead of talking to me.
It's not one or the other, Mr.
Ross, we're doing both.
I'm telling you, I didn't see anything.
- I wasn't even here when it happened.
- So where were you? I parked outside the main entrance waiting for Patricia and the kids.
So why didn't you go with them? To save time.
- We were running late.
- So you were late for what? We were taking the girls to their first soccer practice.
We had to swing by here to pick up their uniforms.
Maddy must be so scared right now.
Mrs.
Ross, I understand that you're terrified, but I really need you to focus.
That's what's going to help me, okay? Now, did anybody look at Maddy or try to talk to her? No, no, nothing like that.
Okay, so you you came out of All-Pro Sports, but she was taken from in front of the bath store.
I decided to make another stop.
Shelly didn't want me to, but I wouldn't listen.
Mom, can't this wait? Friday is your Aunt Lori's birthday.
She loves the stuff in here.
We don't have time.
The game starts in 20 minutes.
Will you just relax? I'm going to buy a gift certificate.
It'll only take a second.
Come on.
All right, just have a seat right there.
Watch your sister and I'll be right back, okay? So you sat down on the bench.
Then what happened? Well, I knew she would be a while, so I decided to do something to pass the time.
No way! Losing again? I am so lame.
I play? Oh! No! No! Mad.
First time I got through a game without you bugging me to play.
Maddy?! Maddy! - Maddy! - Shell, where's Maddy? I don't know.
What do you mean? Where is she? She was just here a second ago.
I swear! Maddy! This is all my fault.
No, it isn't, okay? It really, really isn't.
I can't think of anything else.
I'm sorry.
Don't be sorry.
Don't be.
You did great.
I'm going to step out for a second.
All right? Be back.
What are the odds of her positively ID'ing this guy? Very, very slim.
Didn't anybody else get a look at him? We've an eyewitness that saw Maddy being driven away in a silver Accord but that's it.
All right, what about the security video? The guy's got a hat on, his head down He knows the drill.
He's done it before.
Agent Medina.
Cameras picked up the Accord.
It was exiting the parking lot and it was headed north.
We get the license plate? It was stolen off a Subaru two days ago in Brooklyn.
Odds are the vehicle's stolen, too.
We need to put out a photo of this guy.
I don't know, but none of the angles give us a good shot of his face.
Check the tapes again.
There's more cameras than cars in that parking.
One of them must've caught his face.
We apprehended Andrew Costello at a check-cashing joint.
- His mom wired him some money.
- Great.
Fall in with Agent Johnson.
Actually, NYPD's bringing him in so I can interview him.
On whose authority? - Mine.
- No, no, you let NYPD question him, please.
They're focused on the double homicide.
Talking to this guy is gonna be the quickest way to close this case.
I really need you to cut me some slack on this.
- Yeah, okay, fine.
Yeah, sure.
- Thank you.
Hang on, Agent Johnson wants to talk to you.
Put her on.
Line 3.
We got a match on the abductor's MO.
He lured away three girls Maddy's age in the last two years.
How do you know it's the same guy? Costume jewelry rings were found on their bodies.
They were all strangled with coat hangers.
Well, who is he? Well, the police never had a suspect.
Their only lead was a mid-'80s pickup truck that was seen near where the girls were taken.
- How long did he keep the girls? - Not long.
According to the autopsy reports, they died the same day they were taken.
All right.
We got a pop on the Accord.
Have you seen any trucks like these cruising your neighborhood? Not that I can remember.
Dean? Maybe in a different color? With a camper shell? Has Maddy ever been to Hillside Mall? Or Clinton Dance Studio? What's going on here? Why are you asking about these places, about these trucks? The man who took her may be tied to other abductions.
Other little girls? And if there's some common thread here help to ID him.
Now, has she ever been to Mendelson Park? What happened to them? Sir, I know this is difficult for you, but you just need to answer these questions.
- Do you hear what he's saying? - Dean, please.
Some pervert took Maddy because you had to go get a gift for your sister! Mr.
Ross, you really need to calm down.
I want to know what happened to those other girls! They're dead.
Now sit down and let's get through this.
You son of a bitch! Has Maddy ever been to Mendelson Park? I didn't kill Fran's brother.
I'm not asking you about Fran's brother.
I'm asking you about Ariana Murphy.
- I didn't kill her either.
- Then where is she? I don't know.
It's not my day to watch her.
All right, look, you smart-ass.
You're facing a double murder charge.
You want to add kidnapping to that? Look, I didn't hurt her.
We just went for a ride.
I just wanted the truth.
I got cops staking out my house.
I don't know what's going on, but I didn't kill anybody.
Andrew, please put the gun away.
Fran's lying.
She is a lying bitch.
She set me up.
- And you're in on it with her.
- No.
That's not true.
I just I told the cops what Fran told me.
That's my job.
What did she say? Andy, please let me go.
It's gonna get worse for you if you don't.
I want to know what she said.
Look, you know, maybe you did go to the house just to talk with her, and things just got out of control.
Tyler hit you, and-and - and you had to act in self-defense.
- He didn't hit me! I wasn't even there! I'm just telling you what Fran told me.
She said Tyler hit you over the head with a - flashlight and you pulled your gun.
- Look at my head.
If he hit me, where's the cut? Where's the bruise? You see? So, it couldn't have been me.
That still doesn't answer my question.
What did you do with Ariana? She was right.
I mean, kidnapping her was not going to fix anything.
- I So, I dropped her off.
- Where? SoHo.
Corner of Sullivan and Spring, I think it was.
Sergeant Aguilar? Special Agent Jack Malone.
FBI.
This is Agent Delgado.
I understand you called in the Amber Alert.
I think I pulled your guy over maybe an hour ago.
- Why did you let him go? - The alert was for an Accord.
The update saying it might be a pickup hadn't come through yet.
Did you give him a ticket? No, but I got his info.
Name on his license was Richard Lamb.
I'll run it down.
Okay, I want you to tell me exactly what happened.
Well, I was stopping traffic for some road work.
I saw him pull a 180 across the double-yellow, so I went after him.
- You know why I stopped you, Mr.
Lamb? - Yeah, the U-turn, right? There some reason you're whispering? My daughter is a terrible sleeper.
She's been up all night.
I've been driving her around for two hours, hoping she'd take a nap and she just fell a sleep.
That's no reason to break traffic laws.
Yeah.
I saw the cars starting to slow for the roadwork.
Usually if I stop, she'll wake up, so I wanted to keep moving.
If you got kids, I think you know what I'm talking about.
Yeah.
Yeah.
I'm letting you off with a warning this time.
God bless you for that.
Thank you.
Been there Just obey the rules of the road, okay? I sure will.
Thank you so much, Officer.
He was right there, and I had him.
Did you happen to notice if the little girl was moving? You mean, was she alive? Yeah.
You know, I wish I could say yes, but I just don't know.
What do we have on Richard Lamb? with Parks and Rec.
No criminal record.
We've gone nationwide on the APB.
- A current address? - Cops just raided his house in Yonkers.
He's not there, and neither is Maddy Ross.
Family? Friends? I have it right here.
The parents are dead.
He has a brother, Brent, that lives in Jersey City.
Let's get him in here.
Clark? Based on my conversation with Andrew Costello, I think Ariana's still alive.
- You want more time? - That and I need more bodies.
He said he dropped her off in SoHo, and I need more boots - on the ground to pick up her trail.
- Pull agents from another unit.
I already put in the request, I'm still waiting to hear and I can't leave 'cause I need to reinterview Costello's wife, her story doesn't stand up.
- Sorry, but I can't spare - I'm telling you, - she is out there somewhere.
- And so is Maddy Ross.
And the man who took her killed his other victims within eight hours.
We're at hour six.
You'll be happy to know that your husband's in custody.
Well, that's good.
What about Ariana? Your husband sat there in that chair and told me that he dropped her in SoHo, where she called you from a pay phone.
I haven't heard from her.
- Maybe it went to my voicemail.
- Stop lying! You were here in this building.
I want you to tell me about the call.
- I can't.
- Why not? Who are you protecting? Listen to me.
Ariana was there for you when you needed her.
Now, she is in serious trouble.
The least you can do for her is tell me the truth.
It was after you guys talked to me.
I was waiting to find out when I could get out of here.
Hello? Fran, it's Ariana.
Hey.
Are you all right? What happened at the house, Fran? - Look, I really can't talk right now.
- I don't wanna hear it.
I've been stuck in the car half the night with your crazy husband.
You said he got hit with a flashlight, but he doesn't have a mark on him.
Maybe I remembered wrong.
Maybe there was no flashlight.
I saw it at the house.
Who did Tyler hit, Fran? It wasn't Andrew.
I'd been taking money out of savings, like you told me, so I'd have some cash when I left Andy.
Carla found out.
- That's your daughter? - Yeah.
Her boyfriend's a junkie.
I guess she must have told him.
Mom it's me open the door.
Hey, it's Carla.
Let me in.
- Where's Fran? - Who are you? Get out of my house.
- Carla, what is this? - Zack, let's just go.
- Not till we get what we came for.
- Back off! Don't shoot.
Don't shoot! Please.
- Please, please, please! - No, Zack, don't! Carla is my baby.
I didn't know what else to do, so I said it was Andy.
You should have told me the truth, Fran.
It's my fault.
I'm the reason she's with a guy like Zack.
It's all she's ever seen.
I need to call the police.
She's 17 years old.
Wait, so she's a minor? Yeah.
Is there something you can do for her? I did lots of begging.
Ariana said she'd try to find Carla talk to her.
Do you have any idea how much time you've wasted? I'm sorry.
Where did you tell her to look? Carla has some girlfriends.
I gave her I gave her numbers and addresses.
Okay, I'm gonna need all of that.
And what's Zack's last name? Miller.
Ricky'd never do what you say.
Your brother killed them, Brent.
He killed them.
And this is the last one he took.
Her name is Maddy.
It's not him.
He uses toy rings to lure them.
We found a half a dozen of them at his house.
All the abductions line up with his days off.
And there were traces of chalk on the girls' bodies, the same kind of chalk that he uses to stripe ball fields for Parks and Rec.
You guys set him up That's what I think, like you did with that anthrax guy.
No, we set up anybody.
Look at her.
Look at her face.
Even if I believed you, I don't know where he is.
- We're not that close.
- Then how do you know he's innocent? He's a good person.
- We had a normal childhood.
- I didn't ask you about your childhood.
You wanna talk about that? Am I under arrest? No, you're not, but we would appreciate it if you stick around and work with us.
I can't help you! I'm leaving.
Carla Costello? Maybe.
Get down here, I'm with the FBI.
Come on, let's go.
I didn't do anything.
Where's your boyfriend, Zack? He took off.
Is this woman with him? Was she with him? Did you see her? Yeah, she was here.
What are we gonna do? Where are we gonna go? I don't know, Carla! We wouldn't even be in this mess if it weren't for you.
You said she had the money and she'd give it to us.
You killed them.
That was my family.
Why did you do that? We both did it.
Now shut up and put that in the trunk.
I'll be back with the rest of the stuff Carla? Was that Zack? - Who are you? - I'm a friend of your mom's.
Okay? I I know what happened.
I can help you.
How? First, we need to get you out of here right now.
How do I know this isn't a trick? Carla, don't throw your life away, okay? Your mom made some lousy choices.
That doesn't mean you have to.
Now, come on.
He hit her.
I ran away.
After a while, he quit looking for me and took off.
How long ago was this? Where was he headed? I know he has a brother in Virginia.
This is Fitzgerald, I need to put out an APB right away.
Richard Lamb's brother drove straight home.
Did he call anyone? Nothing on the home phone, nothing on his cell.
Were there any hits on the APB or Well, we found a truck matching the description.
It was a false alarm.
Right truck, wrong year.
They turn anything up at his house that could - point them to where he took her? - We're still looking.
'Cause it's hour nine.
I know.
And - We're running out of moves here, man.
- I know.
What rock have we not looked under? I mean, he's he's gonna kill that little girl.
I could go for a drive.
Yeah, yeah, okay.
Yeah, you do that.
Yeah, yeah, I'm still here.
What? You're sure? Yeah, yeah, okay.
Right.
Thanks.
We found Ariana Murphy.
She bled to death from a blunt-force trauma to the head.
And who killed her? Zack Miller.
Pulled him over on I-95.
She was in the trunk of his car.
So he did the double homicide too? Yeah, that's right.
I missed her by 20 minutes.
I want you to know that.
Turn around! Do not move! Stay perfectly still or I'll blow your brains out.
Don't move a muscle.
- Where's your brother? - I don't know! You can't do this.
You think I care? Last chance Stop! Stop, please.
Your brother didn't stop.
I didn't do anything.
No, you just looked the other way.
I didn't know.
Your brother is a piece of garbage.
You know something.
You better start telling me.
I swear This is what your brother did to those little girls.
You got exactly 30 seconds before you're dead.
Wait wait.
I remember I went to his place.
It might have been about the time that girl disappeared last year.
Keep talking.
I remember there was this state park pass on his dashboard.
To where? The Pine Barrens.
Hey, Maddy.
My name is Clark and I'm a policeman.
I'll take you to your parents, okay? Come here.
Okay.
Sit down.
Congratulations on the Maddy Ross case.
Yeah We lost Ariana Murphy.
And You know, I made the best calls I could, but the fact is that she is dead because of me.
It's part of the job.
Yeah, I guess.
But I can't shake it.
I I can't go where you go, you know, I can't I don't have what you have.
And I don't have what you have.
I hear that the deputy assistant director's job was up for grabs.
Yeah, well, that's that's mostly talk right now.
Nothing like saving a little white girl to leverage your way up the ladder.
Believe it or not, my only goal was to save that girl.
Yeah, just as long as you didn't have to get your hands dirty.
I knew where you were going.
I wanted you to go there.
I wanted you to do whatever it took to save her.
And you did.
So you've got some leverage of your own.
It's not why I did it.
Then, I guess we're both saints Well, I wouldn't go that far.
Well, then, maybe it's best if how Richard Lamb was found was kept between us.
I would like to move on to deputy assistant director.
What do you want, Jack? My job Okay.
Hey, you asked.
Hey, you know what? I'll just recommend to the director that he - reinstate you.
- How is that? Just gonna wave a magic wand? Well he trusts my judgment.
I'll just I'll just tell him that it'd be good for the unit, which is true.
So that's it? That's it.
And soon, all this will be yours again.
Okay.
Hey, Jack.
Well played.
You see, that's your problem, Clark: you still think this is a game
